10.09 Multiple Functions Any person or group of persons may serve in more than one fiduciary capacity with respect to the Plan. 10.10 Tax Effects Neither the Employer, its agents, the Plan Administrator makes any warranty or other representation as to whether any pre-tax contributions made to or on behalf of any Participant hereunder will be treated as excludable from gross income for local, state, or federal income tax purposes. If for any reason it is determined that any amount paid for the benefit of a Participant or beneficiary is includable in an Employee's gross income for local, state or federal income tax purposes, under no circumstances shall the recipient have any recourse against the Plan Administrator or the Employer with respect to any increased taxes or other losses or damages suffered by the Employee as a result. 10.11 Gender and Number Masculine pronouns include the feminine as well as the neutral genders, and the singular shall include the plural, unless indicated otherwise by the context. 10.12 Headings The Article and Section headings contained herein are for convenience of reference only, and shall not be construed as defining or limiting the matter contained thereunder. 10.13 Incorporation by Reference The actual terms and conditions of the separate component Benefit Plans or Policies offered under this Plan are contained in separate, written documents governing each respective benefit, and shall govern in the event of a conflict between the individual plan document, and this Plan as to substantive content. To that end, each such document , as amended or substantially replaced, is hereby incorporated by reference as if fully recited herein. 10.14 Severability Should any part of this Plan subsequently be invalidated by a court of competent jurisdiction, the remainder thereof shall be given effect to the maximum extent possible.
