DESCRIPTION AND CONDITIONS: <br />On December 13, 1990, the Planning and Zoning Commission approved <br />a preliminary plat application submitted by Mosby and Associates, <br />Inc., on behalf of the Stolle Development Corporation, for the <br />Lindsey Lanes Subdivision phases I and II. Phase I has been <br />constructed and received final plat approval. Phase II, a 77 lot <br />single-family residential subdivision located immediately south of <br />the Lindsey Lanes Subdivision Phase I, has not yet received final <br />plat approval. <br />John Hett, on behalf of the Stolle Development Corporation, has <br />requested that an 18 month preliminary plat extension be granted. <br />Due to financial conditions, the applicant has been unable to <br />construct the second and final phase of the approved preliminary <br />plat project. The original preliminary plat approval for the <br />project formally expired on June 13, 1992; however, the request for <br />preliminary plat extension was received prior to expiration of the <br />approved preliminary plat; therefore, the request may be acted upon <br />by the Board of County Commissioners. <br />Stolle Development Corporation is requesting a preliminary plat <br />approval extension pursuant to the provisions of the Subdivision <br />and Plats Ordinance, Chapter 913 of the County's land development <br />regulations. Pursuant to the Subdivision and Plats Ordinance, the <br />Board of County Commissioners =-'s 7r:rt, or grant ::ith conditions, <br />the requested 18 month preliminary plat extension. <br />ANALYSIS: - <br />All county departments have now reviewed the extension request. No <br />department objects to the proposed extension. In staff's opinion, <br />no modification to the preliminary plat is required since the <br />existing, approved preliminary plat application would substantially <br />conform to current LDRs. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners approve <br />Stolle Development Corporation's request for a one (1) time, <br />eighteen (18) month extension of the Lindsey Lanes Subdivision, <br />Phase 21 preliminary plat. The new preliminary plat expiration <br />date will be December 13, 1993. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Wheeler, the Board unanimously (4-0, <br />Commissioner Bird being temporarily delayed), <br />approved a one-time 18 -month extension of a <br />preliminary plat for Lindsey Lanes Subdivision, <br />Phase 2, as requested by Stolle Development <br />Corporation with a new expiration date of December <br />13, 1993, as recommended by staff. <br />D.
