<br />Vacation Rentals & Timeshare Projects
<br />The Division of I•iotras and Restaurams Is responsible for
<br />re,iulating public lodging estrtblishmenrs in. Fiorida, which
<br />includes licensing and inspecting Vacation Rentals and
<br />Time nhare ProJect. (see Chapter 509, Florlda Statutes
<br />(FSI, and Chapter 61 C. Florida .administrative Code
<br />(FAC);.
<br />Florida law defines a 'Public lodging establishment" as
<br />transient public lodging establishments and non -transient
<br />Public lodging establishments. [Section 509.013(4), FSl
<br />Transient public lodging establishment nears "any
<br />unit, group of units, 'd welling, buiiding,.or group of
<br />buildings within a single contplax of Buildings va'tich is
<br />rented to guests more than three.times in a calendar
<br />year for poriods of loss than 30 days rr 1 ,aiendar
<br />month, whichever is bass, or which is advertised or hold
<br />out to the public as a place regularly rented to guests,"
<br />Vacation Rental. Vacation rentals are transient.public
<br />lodging establishments defined in s. 509.242i 1)(c), FS,
<br />as. any unit or group of units in a condornnlum or
<br />cooperative or any individually or coller:tively.owr'red
<br />single-family, Iv✓o-family; threo;family.or four-farnhy
<br />h7use or dwelling unit that is also a transient putific
<br />lodging establishment, but "hat is not 3 Nfrieshare projei t.
<br />Tirneshire Project: A timeshare proporty (as defined in
<br />Cha3ler 721, F.S.` that is located in Florida and is also a
<br />transient public lodging establishment. (E.g.. a
<br />timeshare prcperty that rents by the week to guests
<br />outside t!,e timeshare.community.) (508.242(1)(g),.F S.)
<br />License Classifications
<br />Vacalicn rentals and timeshare project licenses have
<br />three different classifications (61C -1.002(4)(a), F:AC.):
<br />• Single License, May include onesingle home or
<br />:ownhome, or a unit or group of units vArlin a sinole
<br />building that are operated by the owner
<br />• Group License. Covers ail units within a building or
<br />group of -buildings -in a single complex that are licensed
<br />to a licensed.agent. (Mulliple !croup licenses nay be
<br />issued !n different lirensed agents for units Incated on
<br />the same property,)
<br />• Collective. License: Issued to a.group of huuses or
<br />units found in separate locations that are represented
<br />by.lhe sarne licensed agar-.,,. (A ro!lociive'Ilcpnse may
<br />have a maximum of 75 houses or units' per license and
<br />is restricted to counties within one district)

<br />t— same license in any of ilia three licensing categories.
<br />Licensed Agent
<br />A licensed agent is someone that. the property owner has
<br />authorized, through a rental agreement orcontract, to
<br />hold oui the prr)perty for rent una transient'ba sis. The
<br />licensed anent does not have to hold a license from the
<br />Division of Real Estatii.
<br />Only a licensod agent can hold a group or collective
<br />license. A licensed agent may not hold a sinole license
<br />The licensed agent is responsible for all violations cited
<br />during an inspection if the violations occurred while the
<br />unit or dtvnlling was 1;stod urid^-r the licensed agent (or if
<br />the division records list (lie property under theJicensed
<br />ngenl).
<br />Licensing
<br />To obtain a Vacation Rental or Timeshare Project
<br />license you need to fill out an Application for -Vacation
<br />Rental or Timeshare Project License. site, appiication

<br />The Application for License must -be submitted along
<br />with the following items.
<br />• A,list of all units or houses to be.licensed.
<br />• A-comyleied DBPR HR -7020, Certificate of Balcony
<br />Inspection if the units or houses are 3 or more stories
<br />in height and the railings,,s:ainvells and/or oalccmles
<br />are not in common areas.
<br />• Appropriate Fees• Fees are based on the number of
<br />units to be.licenspd. An automated. fee calculator

<br />there is a one-time application processing foe of $50.
<br />Licensing Exclusions
<br />The definition of a•puhlic lodging establishment does trot
<br />include (509.013(4)(b)_F.S'.):
<br />• Any dormitory or other living or sleeping.faci]ity
<br />maintained by a.nuhlic or private school, college, or
<br />university for the use of students, faculty, or visitors.
<br />• Any facility certified or licensed and regulated by filly
<br />Agency for -Health Care Administration (ARCA) or the
<br />Department of Children and Families (DCF) or other
<br />similar elate regulated under s. 381.0072, F.S. E.g.,
<br />hospitals, nursing horses, assisted !ivinll facililios.

<br />• Any migrant labor camp or residents ,l inigrant housing
<br />pennitted by the Oeaartmont of Health (DOH): under
<br />Chapters 381.001-341.00895, F.S or anv mobile
<br />hump park inspected by the Depa tent of Health
<br />(DOH); ami regulated under Chapter 513, F.S
<br />• Any nonprofit organization that operwee n facility
<br />providing -housing only to patients, natients' families,
<br />and patients' caregivers and not to the general public.
<br />• Any apartment building-inspoc.ed by the U.S
<br />Department of Housing and Urban Development
<br />(HUD) that is designated primarily as housing for
<br />per.^,ons at leas( fit years of age. This exclusion
<br />applies to individual buildings, riot entire complexes
<br />(unless every building in the complex fits the criteria).
<br />• Any roominohouse, boardinghouse• or'olher living or
<br />steeping facility that may not hu classified as a'hote:,
<br />motel, apartment, timeshare•pro,190, vacation rental,
<br />nontransient apartment. bed and breakfast inn, or
<br />'transient apartment under s. 509.242, F.S.
<br />Sanitation

<br />dishmachine; OR the epnntor must post a notice
<br />informing guests that the dishes and ,lassware nave
<br />not been sanitized accordinq:to:public t•ood service
