of any of the regulations in sections (i)(1)—(i)(3) shall be punishable as a <br />second degree misdemeanor and by a fine of up to $500.00 per day, per <br />unit, per violation. A code enforcement officer may also enforce the <br />terms of this Chapter by citation under section 103.07 or F.S. § 162.21 <br />(as may be amended). If a code enforcement citation is issued, the fine <br />shall be $250.00 for the first offense and $500.00 for each subsequent <br />offense. (7) ©In addition to any other remedies available to the county <br />(including code enforcement pursuant to section 103.07 or F.S. ch. 162), <br />the county or any other adversely affected person may enforce the <br />terms of this Chapter at law or in equity. Any citizen of the county may <br />seek injunctive relief in a court of competent jurisdiction to prevent a <br />violation of this Chapter or to revoke a vacation rental permit, as set <br />forth in this Chapter. Attorney's fees and costs incurred in an action to <br />enforce the provisions of this Chapter concerning the uses of a vacation <br />rental or unit may be awarded to a substantially prevailing party at the <br />discretion of the court. <br />SECTION #3: SEVERABILITY <br />If any clause, section or provision of this Ordinance shall be declared by a court of <br />competent jurisdiction to be unconstitutional or invalid for any cause or reason, the <br />same shall be eliminated from this Ordinance and the remaining portion of this <br />Ordinance shall be in full force and effect and be as valid as if such invalid portion <br />thereof had not been incorporated therein. <br />SECTION #4: REPEAL OF CONFLICTING ORDINANCES <br />The provisions of any other Indian River County ordinance that are inconsistent or in <br />conflict with the provisions of this Ordinance are repealed to the extent of such <br />inconsistency or conflict. <br />SECTION #5: INCLUSION IN THE CODE OF LAWS AND ORDINANCES <br />The provisions of this Ordinance shall become and be made a part of the Code of Laws <br />and Ordinances of Indian River County, Florida. The sections of this Ordinance may be <br />renumbered or re -lettered to accomplish such, and the word "ordinance" may be <br />changed to "section", "article", or any other appropriate word. <br />SECTION #6: EFFECTIVE DATE <br />This Ordinance shall take effect upon filing with the Department of State. <br />Attachment 10 <br />197 <br />
