CC. 7 5.16 <br />Office of <br />INDIAN RIVER COUNTY <br />ATTORNEY <br />MEMORANDUM <br />TO:- Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: June 23, 2016 <br />SUBJECT: Festival Ordinance <br />BACKGROUND. <br />Under section 205.02 of the Indian River County Code of Ordinances (the "Code"), a festival is defined as <br />any gathering of individuals for the purpose of listening to or participating in entertainment which <br />primarily consists of musical renditions conducted in open spaces not within an enclosed structure. <br />Pursuant to section 205.08 of the Code in order for someone to hold a festival in the unincorporated areas <br />of Indian River County, that person must obtain a permit from the Indian River County Board of County <br />Commissioners (the "Board"). In order for a permit to be issued, requirements pertaining to various <br />facilities, including sanitation, parking, medical and security must be satisfied. Additionally, a festival <br />may not continue for more than eight hours without a 24-hour break. <br />On March 15, 2016, the Board discussed the possibility of amending the Code in order to allow for longer <br />concerts at the Indian River County Fairgrounds. The Board voted to direct the County Attorney and staff <br />to report back to the Board with recommendations on festival policies. <br />The County Attorney's Office in conjunction with the Assistant County Administrator and the Parks <br />Division staff have reviewed the Code with respect to festivals and drafted the proposed ordinance which <br />is attached. <br />Approved for July 5, 2016 BCC Meeting <br />Public Hearing <br />COUNTY ATTORNEY <br />Indian River Co. <br />Appr ed Date <br />Admin. <br />Co.
