Nixon, P.E., Roadway Production Manager <br /> SUBJECT: 211d Street Petition Millings Project (35th Avenue to 32"d Avenue) <br /> Cancelation of Project <br /> DATE: July 1, 2016 <br /> DESCRIPTION AND CONDITIONS <br /> Representatives in the Emerson Park Subdivision presented County staff with a petition to <br /> install asphalt millings on a portion of 2nd Street. This portion of 2nd Street is a dirt road that <br /> begins at 35th Avenue and terminates at 32nd Avenue. <br /> On May 3, 2016 the Board of County Commissioners adopted Resolution No. 2016-041 <br /> providing for certain paving(millings)to 2nd Street Petition Millings Project(35th Avenue to 32nd <br /> Avenue) within the Emerson Park Subdivision. Also on May 3, 2016 the Board of County <br /> Commissioners adopted Resolution No.2016-042 setting the date and time for a Public Hearing <br /> to discuss the process to be taken,costs,and amount of the assessment against each property <br /> owner. The Public Hearing was scheduled and held on June 7,2016. Prior to the Public Hearing <br /> the property owners in favor of the project 68.34° which met the requirements for petition <br /> paving(millings). <br /> At the Public Hearing, one petitioner stated that he was no longer in favor of the project and <br /> another property owner in the assessment area whose identity is confidential,stated,through <br /> his attorney, that he was not properly notified of the process. In response to this,the Board <br /> directed staff to send letters to each of the property owners in the assessment area with actual <br /> costs to determine if the project was still supported. The Public Hearing was deferred and <br /> continued to the July 12, 2016 Board meeting. <br /> Per the Board's direction, letters were sent on June 16,2016 to property owners,along with a <br /> Project Support form to be returned byJune 28,2016. A self-addressed,postage-paid envelope <br /> was enclosed for return of the form.
