RESOLUTION 2014- 100 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE VACATION OF MIRA- <br />MAR SUBDIVISION, PLAT BOOK 1, PAGE 85, INDIAN RIVER COUNTY, <br />a <br />SAID LAND LYING IN INDIAN RIVER COUNTY, FLORIDALn <br />LL N <br />0 v <br />WHEREAS, on August 14, 2013, Indian River County received a duly executed and o N <br />documented application from the Indian River Land Trust, Inc. requesting that the County vacate the <br />00 °' <br />plat of Mira -Mar subdivision recorded in Plat Book 1, Page 85 of Indian River County, Florida, said w U o <br />LL <br />lands lying and being in Indian River County, Florida; and o J o <br />J Q LL <br />CD W } � <br />ED <br />WHEREAS, in accordance with Florida Statutes 177.101, notice of the intent to apply for a 0 z <br />plat vacation was duly published by the Indian River Land Trust, Inc. in two weekly issues of a i = 0 0 <br />newspaper of general circulation in the county; and t,, Z N <br />� " `O <br />� <br />�-U) � WU <br />'0W�>a- <br />WHEREAS, after consideration of the petition, supporting documents, staff investigation ancg 0 w 'If o) <br />report, and testimony of all those interested and present, the board finds that the Indian River Land O Q <br />Trust, Inc. owns the fee simple title to Mira -Mar subdivision; and W W o Co <br />WHEREAS, the Board further finds that vacation of the subdivision plat will not affect the <br />ownership or right of convenient access of persons owning other parts of the subdivision. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />The plat of Mira -Mar subdivision recorded in Plat Book 1, Page 85 of Indian River County, <br />Florida, is hereby vacated. (See Exhibit "A", attached.) <br />2. The Clerk is hereby directed to record this resolution together with the proofs of publication <br />required by Florida Statutes 177.101 in the Official Record Books of Indian River County <br />without undue delay. <br />3. This resolution for the vacation of the Mira -Mar subdivision plat shall not affect any existing <br />utility rights. <br />4. This resolution for the vacation of the Mira -Mar subdivision plat shall not affect the access <br />rights or operations of the Indian River Mosquito Control District. <br />5. This resolution for the vacation of the Mira -Mar subdivision plat shall not affect any other <br />plat or easements of record. <br />The foregoing resolution was offered by Commissioner F Flescher who moved its <br />adoption.
