Indian River County, Florida <br />Memorandum <br />TO: Jason Brown, County Administrator <br />THROUGH: Michael Smykowski, Director, OMB <br />FROM: Beth Martin, Risk Manager <br />, <br />DATE: July 22, 2016 <br />SUBJECT: Mediated Settlement; Meadowbrook/Starr Insurance <br />It is requested that the Board of County Commissioners consider the following Consent <br />Agenda item at their August 16, 2016 regular meeting. <br />Background <br />On April 19, 2016 the Board approved settlement of the July 22, 2009 workers' <br />compensation claim of former fire fighter Otto Lenke. At that time, the County was in <br />negotiations with the excess workers' compensation carrier, Meadowbrook/Starr (MS), <br />over payment of approximately $80,000.00 in excess insurance. <br />Analysis <br />Despite MS's position that their payment should be denied in full due to an intervening <br />date of injury, they subsequently agreed to pay $25,000.00 to resolve the coverage <br />dispute. That agreement was negotiated by defense counsel, Anthony Amelio, and on <br />July 22, 2016 the County Administrator executed the settlement document.
