Szpyrka, P.E� <br />Public Works Director <br />FROM: Kimberly Graham, P1 <br />County Traffic Engi ' eq, <br />SUBJECT: Florida Department of Transportation <br />Traffic Signal Maintenance and Compensation Agreement <br />Revised Terms and Conditions <br />DATE: August 2, 2016 <br />DESCRIPTION AND CONDITIONS <br />On May 19, 2015, the BCC approved a Traffic Signal Maintenance and Compensation Agreement <br />(Agreement) between the Florida Department of Transportation (FDOT) and Indian River County <br />(County). The purpose of the Agreement was to define maintenance, performance measures, and <br />funding responsibilities. <br />At the request of the maintaining agencies, the FDOT evaluated and revised various aspects of the <br />Agreement. The following is a brief outline of the modifications to the Agreement: <br />• Modified Responsibility for Pursuing 3rd Party Damage from the County to FDOT <br />• Changed Responsibility for Periodic Mast Arm Maintenance from the County to FDOT <br />• Simplified Language for Penalties and Retainage <br />• Increased Time to Repair Critical Detectors to 90 Days <br />• Decreased Inspection to 50% of Traffic Signals Every Year <br />• Added Force Majeure Clause <br />In Fiscal Year 2016/2017, the County's funding will increase to $309,704. In subsequent years, the <br />funding will be based on increases in the Consumer Price Index (CPI).
