O'Brien - Assistant County Attorney <br />DATE: June 15, 1992 <br />RE: DISQUALIFICATION OF SCHOPKE CONSTRUCTION COMPANY <br />AS AN ACCEPTABLE BIDDER <br />The attached item was prepared in January of 1992 for consideration by <br />the Board in February. However, the item was removed from the <br />agenda after a meeting with Mr. Schopke and his attorney wherein we <br />felt that agreement had been reached as to the course of conduct by <br />Schopke that would constitute "good faith". <br />We have sought to have Mr. Schopke admit liability to the County but he <br />has refused to do so . We have not, asked that he agree to damages <br />only that he admits that he is liable to the County. Damages would be <br />treated separately - <br />In view of the foregoing, please review the attached memorandum of <br />January 24, 1992 and, if you agree with staff, adopt the attached letter <br />notifying Schopke of his disqualification as an acceptable bidder on <br />County construction projects. <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien - Assistant County Attorney Orpe <br />- e <br />DATE: January 24, 1992 <br />SUBJECT: DISQUALIFICATION OF SCHOPKE CONSTRUCTION <br />COMPANY AS AN ACCEPTABLE BIDDER <br />Schopke Construction Company (Schopke) was the prime- contractor on <br />the construction of Phase II of the new County Jail. As a result of the <br />installation of a defective Electronic Detention and Control System by <br />the sub -contractor Norman K. Dean & Associates through the <br />sub -subcontractor Electronic Control Security, Inc., (ECSI), the County <br />was required to hire another electronic firm to properly install a <br />working system. The hiring of this replacement sub -contractor resulted <br />In the considerable expense to the County. It also resulted in the <br />County suing Schopke. A , brief recapitulation of key events is set <br />forth as follows: <br />- Schopke is awarded the contract to construct Phase II of the <br />new County Jail. <br />Project is bonded by Hartford Insurance Co. <br />- Schopke appears before the BCC on August 13, 1986 through <br />Mr. Crosby who asks permission to substitute ECSI, an <br />unapproved electronic systems contractor, for ESI, an <br />approved electronic systems contractor. Mr. Crosby states <br />that if the substitution is not allowed Schopke will not honor <br />his contract.
