RESOLUTION NO. 2016 -fig <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />APPROVING A COUNTY DEED TO THE CITY OF FELLSMERE, <br />CONVEYING LOT 194, BLOCK 8, HALL, CARTER & JAMES <br />SUBDIVISION, LOCATED AT 1016 BOOKER STREET WITHIN <br />THE CITY OF FELLSMERE. <br />WHEREAS, in 2004, the property located at 1016 Booker Street, legally described as Lot 194, <br />Block 8, Hall, Carter & James, Subdivision, according to the plat thereof as recorded in Plat Book 3, <br />Page 31, Public Records of St. Lucie County, Florida, within the City of Fellsmere (the "Property"), <br />escheated to Indian River County; and <br />WHEREAS, in 2009, Indian River County deeded the property to Every Dream Has A Price, <br />Inc. with various restrictions concerning its use for affordable housing; and <br />WHEREAS, unable to utilize the Property, in 2010, Every Dream Has A Price, Inc. deeded the <br />Property back to Indian River County; and <br />WHEREAS, the Property is located in the City of Fellsmere and Indian River County has no <br />use for the Property, Indian River County wishes to transfer the Property to the City of Fellsmere for <br />parking, drainage or affordable housing; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA THAT: <br />1. The Board finds that the City of Fellsmere has made application as required by Florida <br />Statutes section 125.38 for conveyance of the Property; <br />2. The Property will be used for parking, drainage or affordable housing purposes; <br />3. The Board approves, and authorizes the Chairman to execute the County Deed conveying Lot <br />194, Block 8, Hall, Carter & James, Subdivision, according to the plat thereof as recorded in <br />Plat Book 3, Page 31, Public Records of St. Lucie County, Florida, to the City of Fellsmere for <br />$10.00; and <br />4. The County Deed is executed pursuant to the authority of Florida Statutes sections 125.38 and <br />125.01. <br />The foregoing Resolution was offered by Commissioner Fl Psrher and seconded <br />by Commissioner nav; G and, upon being put to a vote, the vote was as follows: <br />Chairman Bob Solari Ay -F. <br />Vice Chairman Joseph E. Flescher AYE <br />Commissioner Peter D. O'Bryan AYE <br />Commissioner Wesley S. Davis AYE <br />Commissioner Tim Zorc AYE <br />
