RESOLUTION NO. 2016- 1 1 h <br /> A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br /> OF INDIAN RIVER COUNTY, FLORIDA, FORMALLY DESIGNATING <br /> CERTAIN COUNTY OWNED PROPERTY FOR 41s' STREET RIGHT- <br /> OF-WAY NORTHWEST OF THE FLORIDA EAST COAST RAILWAY, <br /> LLC RIGHT-OF-WAY, AND DIRECTING THE PROPERTY APPRAISER <br /> TO CUT OUT THE PROPERTY DESIGNATED AS RIGHT-OF-WAY <br /> FROM THE PARCEL OF PROPERTY IDENTIFIED AS TAX PARCEL <br /> NO. 32392600000300000045.2 IN INDIAN RIVER COUNTY, <br /> FLORIDA. <br /> WHEREAS, Indian River County is the owner of a parcel of property located at the <br /> northwest corner of the intersection of 41St Street and the Florida East Coast Railway, LLC by <br /> virtue of a warranty deed recorded in O.R. Book 1408, Page 1670 of the Public Records of <br /> Indian River County, Florida, and further identified as tax parcel 32392600000300000045.2 ; <br /> and <br /> WHEREAS, recently in the course of preparing roadway plans for 4111 Street, it <br /> became apparent that a portion of the Parcel along 411t Street will be required to be used for <br /> right-of-way for the construction of the roadway improvement and future roadway <br /> expansion; and <br /> WHEREAS, a sketch and legal description of the right-of-way have been prepared and <br /> are attached hereto as Exhibit "A"; and <br /> WHEREAS, would be beneficial to designate by recorded instrument the County's <br /> designation of this right-of-way so that the Indian River County Property Appraiser can <br /> earmark the property as right-of-way on the appropriate maps, as well as cut out the <br /> designated right-of-way from of the Parcel, thus alleviating any potential boundary issues <br /> that may surface in the future. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS <br /> OF INDIAN RIVER COUNTY, FLORIDA that: <br /> 1. That portion of the Parcel running along 411t Street, as described and depicted <br /> on the attached Exhibit "A" is hereby formally designated as right-of-way; and <br /> 2. This resolution shall be recorded in the Public Records of Indian River County, <br /> Florida; and <br /> 3.
