RESOLUTION 2014 - <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING, <br />ABANDONMENT, VACATION AND DISCONTINUANCE OF 90' BY 5' 343 <br />SQ. FT. SLIVER OF SAVANNAH -DRIVE RIGHT-OF-WAY THAT LIES <br />ADJACENT TO A PORTION OF LOT 1 AND TRACT A OF BLOCK 62 IN THE <br />WINDSOR PLAT 25 AS SHOWN IN PLAT BOOK 17, PAGE 32 OF THE <br />PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA <br />WHEREAS, on August 7, 2013, Indian River County received a duly executed and <br />documented petition from Windsor Properties requesting that the County close, vacate, abandon, <br />_discontinue, renounce and disclaim any right, title and interest of the County and the public in and to <br />a 90' by 5' 343- sq. ft.- silver of Savannah Drive right-of-way that lies adjacent to a portion of Lot 1 <br />and Tract A of Block 62 in the Windsor Plat 25 as shown in Plat Book 17, Page 32, of the Public <br />Records of Indian River County, Florida; and <br />WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to <br />consider said petition was duly published, and <br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and <br />report, and testimony of all those_ interested and present, the Board finds that the subject portion of <br />right-of-way is not a state or federal highway, not located within any municipality, not necessary for <br />continuity of the County's street and thoroughfare network, and does not provideexclusiveaccess to <br />WHEREAS, the Board further finds upon notification to all utility providers that the subject <br />right-of-way is not needed for utility purposes and will not be required for utility purposes in the <br />future. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY__ <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1 All right, title and interest of the County and the public in and to that certain right-of-way <br />segment more particularly described as follows: <br />TRACT "A" AND THE NORTH 47.21 FEET OF LOT 1, BLOCK 62, OF THE <br />AFOREMENTIONED PLAT OF WINDSOR PLAT 25, TOGETHER WITH THE <br />FOLLOWING DESCRIBED PORTION OF SAVANNAH DRIVE RIGHT OF WAY <br />AS SHOWNONSAID PLATOFWINDSOR PLAT 25: <br />BEGIN AT THE NORTHWEST CORNER OF SAID TRACT "A": THENCE S 7 <br />DEGREES 00 MINUTES 41 SECONDS EAST, ALONG THE EAST RIGHT OF WAY <br />LINE OF SAVANNAH DRIVE, A DISTANCE OF 43.08 FEET TO THE <br />NORTHWEST CORNER OF SAID LOT 1, BLOCK 62, THENCE S 00 DEGREES 20 <br />MINUTES 48 SECONDS EAST STILL ALONG SAID EAST RIGHT OF WAY LINE <br />AND THE WEST LINE OF SAID LOT 1, A DISTANCE OF 47.21 FEET TO A POINT <br />ON THE SOUTH LINE OF THE NORTH 47.21 FEET OF SIDE LOT 1 THENCE S 89 <br />A.ACHMENT <br />F:\Community Development\CurDev\RESOLUTION\2034 Resolutions\savannaliDr2014- .doc ] <br />SmeadSoft Reprint Date: Wednesday, December 14, 2016 - 11:5632 - BCC:1826, Attachment Td S, Page 141 <br />
