DeBraal, Deputy County Attorney <br />Kate Pingolt Cotner, Assistant Countv Attorney <br />MEMORAND <br />VU: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: February <br />SUBJECT: Resolution eliminating rate equalization charge in non -unincorporated areas of Indian River <br />County <br />BACKGROUND. <br />In 1995, Indian River County (the "County") and the City of Sebastian (the "City") entered into an <br />interlocal agreement providing for the transfer of the City's water and wastewater system to the County (the <br />"Agreement"). The Agreement authorized the County to charge a rate equalization charge within the City. <br />That same year, the Board of County Commissioners (the `Board") adopted Resolution _95-16_creating a <br />new rate equalization charge of 6%, comparable to the franchise fee charged_ in _those unincorporated areas <br />of the County, to be added to the total amount of water and sewer charges in the non -unincorporated areas <br />of fka r. ..... - <br />__ On February _18, 2014, the Board voted to eliminate the rate equalization charge. Pursuant to that vote, the <br />County Attorney's __Office drafted a resolution eliminating the rate equalization charge created per <br />Resolution 95-16. Based -upon communication with County staff, the County Attorney's Office has <br />proposed in the attached resolution that the elimination of the rate equalization charge in the non - <br />unincorporated areas of the County go into effect on October 1, 2014. <br />CO.
