• <br />• <br />• <br />2194 LAWS OF FLORIDA <br />by reason of such right-of-way ; to require owners of property or <br />their agents to keep their lots, tracts or parcels of land free <br />and clean of weeds, brush, undergrowth, trash, filth, garbage or <br />other refuse or in case of their failure to do so the City may <br />remove or cause the removal of such weeds, brush, undergrowth, <br />trash, filth, garbage or other refuse, and may charge and assess <br />the expense thereof against the property so cleaned and improved, <br />to provide for the care and protection of trees, shrubs and flowers <br />in the public streets, avenues, parks and grounds, to impose pen- <br />alties on the owner or occupant of or agent for any sidewalk, <br />house or other structure, place or thing which may be dangerous <br />or detrimental to the inhabitants of said City or dangerous or <br />detrimental to their property unless after due notice the same be <br />-removed or remedied in accordance with the requirements of the <br />City Council. <br />Section 43. The Council shall have the ppwer by ordinance to <br />acquire, improve and maintain parks for the benefit of the City <br />and its inhabitants. <br />Section 44. That said City is hereby delegated authority to <br />exercise the right and power of eminent domain, that is, the <br />right to appropriate .property within or without the territorial <br />limits of said City for the following uses or purposes: For <br />streets, lanes, alleys and ways; for public parks, squares and <br />grounds; for drainage and for raising or filling in land in order <br />to promote sanitation and healthfulness; for reclaiming and filling <br />when lands are low or wet or overflowed altogether at times, and <br />entirely or partly; for the abatement of any nuisance; for the <br />use of water pipes and for sewerage and drainage purposes; for <br />laying wires and conduits under the ground; for City buildings, <br />waterworks, electric light plants, pounds, bridges, seawalls, bulk- <br />heads, causeways, municipal docks, golf courses, air ports, and <br />any other municipal purpose; which shall be coextensive with <br />the powers of said City exercising the right of eminent domain <br />under this section ; and the absolute, fee simple title to all property <br />so taken and acquired shall vest in the said City, unless the City <br />seeks to condemn a particular right or estate in such property. <br />That the procedure for the exercise of eminent domain or the <br />condemnation of any lands or property under this section shall <br />be the same as is provided by the general laws of Florida on the <br />subject of condemnation of property for public uses. <br />Section 45. The Council shall have power by ordinance to <br />provide for the construction, improvement and maintenance of <br />
