The State of Florida's performance and obligation to pay under this Agreement is <br />contingent upon an annual appropriation by the Legislature. If the Department's funding for this Project is in multiple <br />fiscal years, funds approval from the Department's Comptroller must be received each fiscal year prior to costs being <br />incurred. See Exhibit "B" for funding levels by fiscal year. Project costs utilizing these fiscal year funds are not eligible <br />for reimbursement if incurred prior to funds approval being received The Department will notify the Agency, in writing, <br />when funds are available. <br />15.20 Multi -Year Commitment. In the event this Agreement is in excess of $25,000 and has a term for a period of more <br />than one (1) year, the provisions of Chapter 339.135(6)(a), Florida Statutes, are hereby incorporated: <br />"The Department, during any fiscal year, shall not expend money, incur any liability, or enter into any <br />contract which, by its terms, involves the expenditure of money in excess of the amounts budgeted as <br />available for expenditure during such fiscal year. Any contract, verbal or written, made in violation of this <br />subsection is null and void, and no money may be paid on such contract. The Department shall require a <br />statement from the comptroller of the Department that funds are available prior to entering into any such <br />contract or other binding commitment of funds. Nothing herein contained shall prevent the making of <br />contracts for periods exceeding 1 year, but any contract so made shall be executory only for the value of <br />the services to be rendered or agreed to be paid for in succeeding fiscal years; and this paragraph shall be <br />incorporated verbatim in all contracts of the Department which are for an amount in excess of $25,000 and <br />which have a term for a period of more than 1 year." <br />16.00 Expiration of Agreement. The Agency agrees to complete the Project on or before October 31, 2019. If the <br />Agency does not complete the Project within this time period, this Agreement will expire unless an extension of the time <br />period is requested by the Agency and granted in writing by the Department prior to expiration of this Agreement. <br />Expiration of this Agreement will be considered termination of the Project and the procedure established in Section 8.00 <br />of this Agreement shall be initiated. The cost of any work performed after the expiration date of this Agreement will not <br />be reimbursed by the Department. <br />16.10 Final Invoice. The Agency must submit the final invoice on this Project to the Department within 120 days aftei <br />the expiration of this Agreement. <br />17.00 Agreement Format. All words used in this Agreement in the singular form shall extend to and include the plural.'; <br />All words used in the plural form shall extend to and include the singular. All words used in any gender shall extend toy <br />and include all genders. 1. <br />18.00 Execution of Agreement. This Agreement may be simultaneously executed in a minimum of two counterparts, <br />each of which so executed shall be deemed to be an original, and such counterparts together shall constitute one in the i <br />same instrument. <br />19.00 Restrictions on Lobbying: <br />19.10 Federal. The Agency agrees that no federally -appropriated funds have been paid, or will be paid by or on behalf <br />of the Agency, to any person for influencing or attempting to influence any officer or employee of any federal agency, a <br />Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with <br />the awarding of any federal contract, the making of any federal grant, the making of any federal loan, the entering into of <br />any cooperative agreement, and the extension, continuation, renewal, amendment or modification of any federal <br />contract, grant, loan or cooperative agreement. <br />104 <br />
