DeBraal, Deputy County Attorney <br />Kate Pingolt Cotner, Assistant County Attorney <br />MEMORANDUM <br />TO: The Board of County Commissioners <br />FROM: Dylan Reingold - County Attorney <br />DATE: September 27, 2016 <br />ATTORNEY <br />SUBJECT: Blue Goose Sand Mine (formerly known as Ranch Road Lake Sand Mine) <br />— Transfer of Compliance and Restoration Escrow from Phase 1 to Phase 3 <br />Phase 1 of Blue Goose Sand Mine (formerly known as Ranch Road Lake Sand Mine) has <br />been restored to the satisfaction of the County based on a site inspection, and the <br />Developer is ready to proceed to Phase 3 and wishes to transfer those funds presently in <br />escrow with the County from Phase 1 to Phase 3. <br />Attached for your approval is a Cash Deposit and Escrow Agreement for Compliance and <br />Restoration for Phase 3. The compliance security is in the amount of $70,290.00; and the <br />restoration security is in the amount of $51,430.00, and the agreement earmarks the <br />transfer of the funds. <br />FUNDING: <br />There is no cost associated with this item. <br />RECOMMENDATION: <br />Authorize the Chairman of the Board of County Commissioners to execute the attached <br />Cash Deposit and Escrow Agreement for Compliance and Restoration with regard to the <br />transfer of escrowed funds from Phase 1 to Phase 3. <br />/nhm <br />Attachment <br />Approved for October 4, 2016 BCC Meeting <br />CONSENT <br />COU&TY ATTORNEY <br />Indian River Co.
