Dylan Retngold, Courm-AttorneV <br />\\ dbam K Detiraal, Deputti Counn, Attornct <br />Kate Putgolt Cotner, Asstsrant County .Attorney <br />QV CP. q f <br />INDIAN <br />MEMORANDUM <br />RIVER COUNTY <br />TO: Stan Boling, Director, Community Development Department <br />FROM: Dylan Reingold, County Attorney <br />DATE: September 29, 2016 1 <br />SUBJECT: Medical Marijuana Treatment Centers <br />ATTORNEY <br />As the Indian River County Board of County Commissioners (the "Board') considers adopting land <br />development regulations concerning medical marijuana treatment centers under Amendment 2, 1 <br />recommend that the Board consider authorizing staff to advertise for a public hearing for an ordinance <br />amending the Indian River County Pain Management Clinic and Controlled Substances Ordinance, <br />Chapter 315 of the Indian River County Code of Ordinances (the "Ordinance"), to clarify some of the <br />language within the Ordinance, including the definition of a medical marijuana treatment center and that <br />cultivation of marijuana is prohibited. Please note that pursuant to section 381 986(8) of the Florida <br />Statutes, the state has preempted "[a]ll matters regarding the regulation of the cultivation and processing <br />of medical cannabis or low -THC cannabis by dispensing organizations . . ." Thus, I recommend <br />excepting cultivation for such limited purposes. Please find attached draft language for an ordinance <br />concerning Medical Marijuana Treatment Centers As section 381.986, Florida Statutes, addresses low - <br />THC and medical cannabis, I recommend that any potential regulations concerning such uses be <br />addressed under a separate discussion item. <br />F Wllorne-ODOun-A9etno to Stan holing - Medreal Maryuunu Treatment Centet.doc <br />Attachment 2 <br />18 <br />
