In 2014, the farmers market concept was discussed at Gifford Neighborhood Plan meetings and was <br />incorporated into "Action 6.5" which was adopted as part of the neighborhood plan. That <br />neighborhood plan action calls for the County to consider special regulations for food and produce <br />sales in Gifford via temporary use regulations (see attachment 41). To move the Farmers market <br />concept forward, in 2015 staff reviewed research conducted for the 2012 community meeting, <br />coordinated with Gifford community leaders, and drafted a Gifford -specific set of temporary use <br />permit regulations that would allow food and produce market sales and events, with special criteria. <br />Staff presented the initial draft regulations to the Board of County Commissioners (BCC) at its <br />December 8, 2015 meeting. At that meeting, the Board considered the initial draft, provided <br />comments, and directed staff to initiate the formal process for adopting regulations including <br />conducting a workshop in Gifford and coordinating with Gifford community leaders (see attachment <br />#3). <br />After the December 8, 2015 Board meeting, staff coordinated with Gifford community leaders and <br />presented a revised draft ordinance at a well -attended Progressive Civic League public meeting held <br />at the Gifford Community Center on March 7, 2016. At that meeting, staff received input from a <br />number of citizens and there was community support for a reasonably regulated daytime farmers <br />market at a public park or commercial site in Gifford (see attachment #4). Since the March 7, 2016 <br />community meeting, staff has coordinated with the County Attorney, community leaders, and <br />interested community residents, and drafted a proposed ordinance that is now ready for formal <br />consideration. <br />• PZC Action <br />At the August 11, 2016 PZC meeting, the PZC conducted a public hearing and voted 5 — 0 to <br />recommend that the Board of County Commissioners adopt the proposed ordinance (see attachment <br />#5). <br />The BCC is now to conduct a public hearing and adopt, adopt with modifications, or deny the <br />proposed ordinance. <br />ANALYSIS <br />The proposed regulations are structured as a new sub -section of the temporary use permit regulations <br />(see attachment #6). If adopted, the new regulations will allow staff to issue a renewable temporary <br />use permit to an applicant for a farmers market site in the area of Gifford that lies east of 58th Avenue <br />and west of US 1. As currently proposed, a farmers market site must be located on a <br />commercial/industrial property or a public park, must have direct access to a major road, must <br />accommodate multiple vendors, and must be open to the public. Through the temporary use permit <br />process, a year-long schedule of weekly, 3 day events can be approved for a particular site. The <br />proposed ordinance specifically waives the normal temporary use permit application fee ($75) in <br />order to encourage a farmers market. In addition, the proposed ordinance reduces the normal <br />refundable temporary event site clean-up deposit from $200 to $25. The $25 amount was supported <br />by residents at the March 7 community meeting who indicated that it would be good to require a <br />modest deposit as an incentive to keep the site clean.
