DeBraal — Deputy County Attorney <br />THROUGH: Manny Cabo — Telecommunications Manager <br />DATE: September 12, 2016 <br />ATTORNEY <br />SUBJECT: Antenna and Rack Space Lease with the Federal Aviation Administration <br />at Hobart Tower <br />The County's Hobart Park has been the site of communication towers for the last 30 years. The <br />hurricanes of 2004 and 2005 damaged the then existing tower to the point where it had to be replaced <br />for safety concerns. In 2008, the County entered into a License Agreement (Agreement) with Global <br />Tower Assets, LLC (Global Tower) to construct a new tower at Hobart Park. The Agreement called <br />for Global Tower to construct and retain ownership of a new tower, transfer the other users: the <br />Federal Aviation Administration (FAA) and Florida Power and Light (FPL) from the damaged tower <br />and take down the damaged tower at no cost to the County. The terms of the Agreement with Global <br />Tower (now American Tower) call for the County to receive 100% of the rent from the leases with <br />the FAA and FPL. <br />The FAA has been a tenant of the County since 1996. The current agreement with the FAA ends on <br />September 30, 2016. The FAA has a minimal amount of equipment located at the tower site. It <br />consists of an equipment cabinet about the size of a 4 drawer office file and small antenna on the <br />tower. There is no generator or fuel tank associated with this colocation. The FAA supports the <br />National Air Space which in turn provides safety to the County, its residents and the general flying <br />public. Their antennas, and remote communications guide the airplanes and provide for safe flying <br />conditions for the County's busy flying community. The annual rent proposed is $2,400.00 annually <br />or $200.00 per month for the 10 year term of the lease.
