iii With respect to any Subgrantee/Subrecipient other than a State agency or political subdivision of the State, which receives funds under this Agree- ment from the federal government, to the best of its knowledge and belief, that it and its principals 1 are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered trans- actions by any federal department or agency; 2 have not within the five-year period preceding entering into this Agreement had one or more public transactions (federal, State, or local) terminated for cause or default; and 3 have not within the five-year period preceding entering into this proposal been convicted of or had a civil judgment rendered against them for- a) ora) the commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (federal, State, or local) transaction or a contract under public transaction, or b) violation of federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification, or de- struction of records, making false statements, or receiving stolen property b. The Subgrantee/Subrecipient certifies that to the best of its knowledge and belief- i. No federal appropriated funds have been or will be paid, by or on behalf of the Subgrantee/Subrecipient, to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the awarding of any federal contract, the making of any federal grant, the making of any federal loan, the entering into of any cooperative agreement, or the extension, continuation, renewal, amendment, or modification of any federal contract, grant, loan or cooper- ative agreement. 1. Subgrantee/Subrecipient understands that if any funds other than federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with this federal contract, grant, loan or cooperative agreement, the Subgrantee/Subrecipient must complete and submit Standard Form-LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions ii All unmanufactured and manufactured articles, materials and supplies which are acquired for public use under this Agreement have been produced in the United States as required by 41 U S C § 10a, unless it would not be in the public interest or unreasonable in cost. c The Subgrantee/Subrecipient understands and agrees that the language of this certification must be included in the award documents for all sub awards at all tiers PA Funding Agreement FEMA-4283-DR-FL page 17 of 23
