The Board reviewed memo from Community Development Director <br />Bob Keating dated July 13, 1992: <br />TO: James Chandler <br />County Administrator <br />DEPARTMENT HEAD CONCURRENCE <br />Robert M. eat ng, CP <br />Community Develop <br />/m <br />��ent Director <br />FROM: Sasan Rohani <;°'`' <br />Chief, Long -Range Planning <br />DATE: July 13, 1992 <br />RE: COUNTY INITIATED REQUEST TO ADMINISTRATIVELY REZONE <br />PARCELS WITH ZONING AND PLAN DESIGNATION INCONSISTENCIES <br />(RZON-92050082) <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their special <br />night meeting of July 21, 1992. <br />BACKGROUND <br />Indian River County adopted its Comprehensive Plan on February 13, <br />1990. Pursuant to the Local Government Comprehensive Planning and <br />Land Development Regulation Act of 1985, a copy of the adopted plan <br />was then sent to the Florida Department of Community Affairs (DCA) <br />for its compliance review. After review, the DCA issued a <br />statement of intent to find the Indian River County Comprehensive <br />Plan not in compliance. After negotiating a stipulated settlement <br />agreement with DCA, Indian River County, on June 18, 1991, amended <br />Its Comprehensive Plan, pursuant to the terms of that agreement. <br />As approved, the stipulated settlement agreement between the county <br />and DCA revised portions of the Comprehensive Plan;. significant <br />changes were made to the Future Land Use Map. With these <br />revisions, the land use designation was changed for many parcels <br />within the county. Consequently, many parcels were assigned land <br />use designations not corresponding to their current zoning <br />classifications. <br />Since state law (Chapter 163, F.S. and Rule 9J-51 Florida <br />Administrative Code) requires that all local governments eliminate <br />any inconsistency between the zoning and land use designations of <br />properties within their jurisdictions, Indian River County is <br />undertaking this rezoning action. <br />On May 28, 1992, the Planning and Zoning Commission voted 6-0 to <br />recommend to the Board of County Commissioners to approve this <br />request to administratively rezone the subject parcels as shown on <br />attachment 4. <br />On July 81 1992, the Board of County Commissioners considered this <br />request, provided direction to staff, and announced their intention <br />to have a second special night hearing on July 21, 1992, to take <br />final action. At the July 8th meeting, several issues were raised <br />by Robert Schlitt. These have been addressed in a response letter <br />to Mr. Schlitt, a copy of which is attached to this staff report. <br />BOOK Y it u <br />J U L 211992 <br />
