DeBraal, Deputy County Attorney <br />Kate Pingolt Cotner, Assistant County Attorney <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold — County Attorney <br />DATE: October 12, 2016 <br />SUBJECT: Escheated Property Located Within the Municipal Boundaries of the City <br />of Fellsmere <br />Two lots located within the municipal boundaries of the City of Fellsmere escheated to <br />Indian River County. This property had been on the List of Lands Available for Taxes for <br />the prerequisite three years, and the Clerk of Court issued and recorded an Escheatment <br />Tax Deed. The property is identified as.- <br />Lots <br />s: <br />Lots 5 and 6, Lincoln Park Subdivision, as recorded in Plat Book 1, Page 60 <br />Site address: 12960 100th Place, Fellsmere, Florida 32948 <br />Since this property is located within the boundaries of an incorporated municipality of the <br />County, and because the property was not acquired for infill housing and no applications <br />for restitution of the property were filed by the record fee simple owners of the property <br />as of the date the county obtained title, the County is required under Section 197.592(3), <br />Florida Statutes, to convey the property to the governing board of the municipality in which <br />the land is located. <br />Approved for October 18, 2016 BCC Meeting <br />(CONSENT) <br />I�OUNTY ATTORNEY <br />31 <br />
