BOOK 8Y F,,.14 7 <br />Attorney Vitunac explained that the Florida Legislature passed <br />Chapter 92-103 during this year's session which establishes <br />standards for late night retail stores and preempts the County's <br />local regulations as of December 31, 1992. Our ordinance will be <br />in effect until then. <br />Commissioner Scurlock asked if the State's ordinance is less <br />restrictive than ours. <br />Assistant County Attorney .Terry O'Brien advised that <br />essentially it will be the same with a slight difference between <br />the hours when the County ordinance would be in effect and the <br />hours when the State law would be in effect. <br />Chairman Eggert opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. There being none, she closed <br />the Public Hearing. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously adopted <br />Ordinance 92-30, declaring Chapter 13 3/4, Late <br />Night Retail Stores, null and void effective <br />December 31, 1992. <br />ORDINANCE 92 -gyp <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, DECLARING CHAPTER 13 3/4 LATE <br />NIGHT RETAIL STORES NULL AND VOID <br />EFFECTIVE DECEMBER 31, 1992. <br />WHEREAS, the Florida Legislature at its 1992 session passed <br />Chapter 92-103 which establishes standards for late night retail <br />stores; and <br />WHEREAS, this act preempts the County's local regulations <br />as of December 31, 1992, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA <br />that: <br />SECTION 1.
