Board of County Commissioners Meeting Minutes - Final November 15, 2016 <br />Attachments: Staff Report <br />Proposed Ordinance <br />Proof of Publication of Advertisement for Hearing is on file in the Office of the <br />Clerk to the Board. <br />Assistant County Attorney Kate Pingolt-Cotner reported that in accordance with <br />the Board's direction on October 4, 2016, the County Attorney's office has drafted <br />a proposed Ordinance creating a new Chapter 317 of County Code, titled Oil and <br />Gas Well Stimulation Prohibited. She provided an overview of the proposed <br />Ordinance and addressed questions from the Board. <br />The Chairman opened the Public Hearing; there were no speakers, and the <br />Chairman closed the public hearing. <br />Commissioner Zorc stated that he was not in favor of a total prohibition on <br />fracking, because there may be a location in the state where fracking could be <br />appropriate. He clarified that he would support the proposed Ordinance for the <br />purpose of being able to revisit the law in the future. <br />A motion was made by Commissioner O'Bryan, seconded by Vice Chairman <br />Flescher, to adopt Ordinance 2016-015, creating Chapter 317 of the Code of <br />Indian River County, Florida, entitled "Oil and Gas Well Stimulation Prohibited"; <br />Prohibiting Oil and Gas Well Stimulation; and providing for codification, <br />severability, a general repealer and an effective date. The motion carried by the <br />following vote: <br />Aye: 5 -Chairman Solari, Vice Chairman Flescher, Commissioner Davis, Commissioner <br />O'Bryan, and Commissioner Zorc <br />B.
