SMITH, CLERK <br />Florida Department of Transportation <br />Surveying and Mapping Office <br />605 Suwannee Street MS -5L <br />Tallahassee, F132399-0450 <br />850.414.7962 <br />Memorandum of Agreement <br />/A/0 7/40/4/ <br />11.3 <br />gG <br />ANATH PRESAUD <br />SECRATARY <br />This Memorandum of Agreement is entered this 1-71-1-1 day of re., , ?9/4, between the <br />State of Florida, Department of Transportation, an agency of the State of Florida, hereinafter called the <br />"Department", and Indian River County, Florida, hereinafter called the "Agency". <br />The Department desires to establish a statewide Global Positioning System (GPS) Reference <br />Station Network for purposes of collecting geodetic GPS data, and the Agency consents to allow the <br />Department to locate a Reference Station on its -property, and in consideration of the mutual covenants, <br />promises, and representations herein set forth, agree as follows: <br />1. The Agency hereby gives permission to the Department and its representatives, agents, and <br />contractors, to enter the Agency's premises at: 1225 5t Street SW, Vero Beach, Florida 32962, <br />hereinafter called the Project Site, to construct, maintain, and operate the GPS Reference Station, <br />hereinafter called the Project, further described in Exhibit A, attached and incorporated by -reference <br />herein. <br />2. The Department shall be responsible for all costs for the construction, installation, maintenance, <br />and operation of the Project described in Exhibit A. The Agency shall be held harmless and exempt of said <br />responsibilities and, to the extent permitted by law, any damage to the equipment shown in Exhibit A. <br />3. Each party shall designate a representative to administer this Agreement, to receive or respond to <br />notices or correspondences in relation to the Project at the Project Site. All notices or demands which may <br />be given, made, or sent to the following representatives will be deemed to have been fully given, made, or <br />sent when in writing and delivered to the other party by US Mail, facsimile transmission, courier service, or <br />personal delivery: <br />To the Department: John Krause, State Surveyor <br />Address: 605 Suwannee Street Tallahassee, Florida 32399 <br />To the Agency: David W. Schryver, County Surveyor <br />Address: 1801 27th street (Building A) Vero Beach, Florida 32960 <br />Any changes to the above representatives or address must be provided to the other party in writing. <br />4. The Agency shall provide written approval of the Project location on the Project Site. Party <br />representatives will determine the location for the permanent antenna mount and equipment installation. <br />5. The Agency will assess no cost to the Department for the use of its premises for the Project. <br />6. The Agency will provide electrical service to the Project at no cost to the Department. <br />
