ORDINANCE NO. 90.11 <br />AN, ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RM -6, <br />MULTIPLE -FAMILY RESIDENTIAL DISTRICT TO CL, LIMITED COMMER- <br />CIAL DISTRICT, FOR THE PROPERTY GENERALLY LOCATED ON 12TH <br />STREET APPROXIMATELY 580 FEET WEST OF OLD DIXIE HIGHWAY, AND <br />DESCRIBED HEREIN, AND PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />A PARCEL OF LAND SITUATE IN THE SOUTH HALF OF THE SOUTHWEST <br />QUARTER OF THE NORTHWEST QUARTER OF SECTION 12, TOWNSHIP 33 <br />SOUTH, RANGE 39 EAST, LYING WEST OF OLD DIXIE HIGHWAY, BEING <br />MORE PARTICULARLY DESCRIBED AS FOLLOWS: <br />COMMENCE AT THE SOUTHWEST CORNER OF THE SAID SOUTHWEST QUARTER <br />OF THE NORTHWEST QUARTER; THENCE N00 0511911E, ALONG THE WEST <br />LINE OF THE SAID NORTHWEST QUARTER, A DISTANCE OF 35.00 FEET; <br />THENCE S88 27' 29"E, ALONG THE NORTH RIGHT-OF-WAY LINE OF 12TH <br />STREET, A DISTANCE OF 450.00 FEET TO THE POINT OF BEGINNING; <br />THENCE CONTINUE S88 27'29"E, ALONG THE SAID NORTH RIGHT-OF- <br />WAY LINE, A DISTANCE OF 228.66 FEET; THENCE N15 06' 45"W, A <br />DISTANCE OF 654.27 FEET; THENCE N89 51' ll"W, A DISTANCE OF <br />57.03 FEET; THENCE; S00 05' 19"W, PARALLEL WITH THE SAID WEST <br />LINE OF THE NORTHWEST QUARTER, A DISTANCE OF 625.64 FEET TO <br />THE POINT OF BEGINNING. <br />CONTAINING 2.05 ACRES, MORE OR LESS. <br />Be changed from RM -6, Multiple -Family Residential District to <br />CL, Limited Commercial District. <br />All with the meaning and intent and as set forth and described in <br />said Zoning Regulations. <br />
