iii. With respect to any Subgrantee/Subrecipient other than a State agency or <br />political subdivision of the State, which receives funds under this Agree- <br />ment from the federal government, to the best of its knowledge and belief, <br />that it and its principals: <br />1. are not presently debarred, suspended, proposed for debarment, <br />declared ineligible, or voluntarily excluded from covered trans- <br />actions by any federal department or agency; <br />2. have not within the five-year period preceding entering into this <br />Agreement had one or more public transactions (federal, State, or <br />local) terminated for cause or default; and <br />3. have not within the five-year period preceding entering into this <br />proposal been convicted of or had a civil judgment rendered against <br />them for: <br />a) the commission of fraud or a criminal offense in connection <br />with obtaining, attempting to obtain, or performing a public <br />(federal, State, or local) transaction or a contract under <br />public transaction, or <br />b) violation of federal or State antitrust statutes or commission <br />of embezzlement, theft, forgery, bribery, falsification, or de- <br />struction of records, making false statements, or receiving <br />stolen property. <br />b. The Subgrantee/Subrecipient certifies that to the best of its knowledge and belief: <br />No federal appropriated funds have been or will be paid, by or on behalf of <br />the Subgrantee/Subrecipient, to any person for influencing or attempting to <br />influence an officer or employee of any agency, a Member of Congress, an <br />officer or employee of Congress, or an employee of a Member of Congress <br />in connection with the awarding of any federal contract, the making of any <br />federal grant, the making of any federal loan, the entering into of any <br />cooperative agreement, or the extension, continuation, renewal, <br />amendment, or modification of any federal contract, grant, loan or cooper- <br />ative agreement. <br />1. Subgrantee/Subrecipient understands that if any funds other than <br />federal appropriated funds have been paid or will be paid to any <br />person for influencing or attempting to influence an officer or <br />employee of any agency, a Member of Congress, an officer or <br />employee of Congress, or an employee of a Member of Congress <br />in connection with this federal contract, grant, loan or cooperative <br />agreement, the Subgrantee/Subrecipient must complete and <br />submit Standard Form -LLL, "Disclosure Form to Report Lobbying," <br />in accordance with its instructions. <br />ii. All unmanufactured and manufactured articles, materials and supplies <br />which are acquired for public use under this Agreement have been <br />produced in the United States as required by 41 U.S.C. § 10a, unless it <br />would not be in the public interest or unreasonable in cost. <br />c. The Subgrantee/Subrecipient understands and agrees that the language of this <br />certification must be included in the award documents for all sub awards at all tiers <br />PA Funding Agreement FEMA -4283 -DR -FL <br />page 17 of 23 <br />P70 <br />
