SECTION 00421 <br /> FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION <br /> CONTRACT REQUIREMENTS <br /> FEDERAL FUNDS.This Contract relies on federal funds,therefore several additional <br /> terms and conditions apply: <br /> A. Prior Approval to Expend Federal Funds to Federal Agency or Employee.It is <br /> understood and agreed that the Contractor is not authorized to expend any federal funds under <br /> this Contract to a federal agency or employee without the prior written approval of the awarding <br /> federal agency. <br /> B. Compliance with Federal Laws,Rules and Regulations. As applicable,Contractor shall <br /> comply with all federal laws,rules,and regulations,including but not limited to: <br /> • Equal Employment Opportunity.Executive Order 11246 of September 24, 1965,entitled <br /> "Equal Employment Opportunity,"as amended by Executive Order 11375 of October 13, <br /> 1967,and as supplemented in Department of Labor regulations(41 CFR Chapter 60). <br /> Section 200.326 and Appendix 11,OMB Uniform Guidance(2 CFR 200),Applicable, <br /> except as otherwise provide under 41 CFR Part 60,to any grant,contract,loan,insurance, <br /> or guarantee involving Federal assisted construction. <br /> • The Copeland "Anti-Kickback"Act(18 U.S.C. 874,and 40 U.S.C. §314)as r. <br /> supplemented in Department of Labor regulations(29 CFR part 3).Under this Act, <br /> contractors and subrecipients are prohibited from inducing,by any means,any person <br /> employed in the construction,completion,or repair of public work,to give up any part of <br /> the compensation to which he or she is otherwise entitled, <br /> • The Davis Bacon Act 40 U.S.C. 3141-3144,and 3146-3148)as supplemented by <br /> Department of Labor regulations(29 CFR Part 5,"Labor Standards Provisions <br /> Applicable to Contracts Covering Federally Financed and Assisted Construction."Under <br /> this Act contractors and subcontractors must pay their laborers and mechanics employed <br /> under the contract no less than the locally prevailing wages and fringe benefits for <br /> corresponding work on similar projects in the area. <br /> * Suspension and Debarment The bidder or proposer agrees to comply with the <br /> requirements of 2 C.F.R.pt. 180,subpart C and 2 C.F.R.pt 3000, subpart C while this <br /> offer is valid and throughout the period of any contract that may arise from this offer. The <br /> bidder or proposer further agrees to include a provision requiring such compliance in its <br /> lower tier covered transactions. <br /> • Contract Work Hours and Safety Standards Act. Sections 103 and 107 of the Agreement <br /> Work Hours and Safety Standards Act(40 U.S.C. 327-330)as supplemented by <br /> Department of Labor regulations(29 CFR part 5).
