M <br />ON _MOTION by Commissioner Bird, SECONDED by <br />Commissioner Scurlock, the Board unanimously (3-0, <br />Chairman Eggert being absent) adopted Ordinance 92- <br />35, amending Chapter 201, County Water and Sewer <br />Services, of the Code of Laws and Ordinances of <br />Indian River County, Florida, as recommended by <br />staff. <br />ORDINANCE NO. 92- 35 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, AMENDING CHAPTER 201; COUNTY <br />WATER AND SEWER SERVICES, OF THE CODE <br />OF LAWS AND ORDINANCES OF INDIAN RIVER <br />COUNTY, FLORIDA, WHICH CHAPTER WAS <br />ADOPTED BY ORDINANCE NO. 91-9,' WHICH <br />PRESENT AMENDMENT CALLS "FOR AN <br />ANNUAL REVIEW OF USER CHARGES AND AN <br />ANNUAL NOTIFICATION OF THE RATES <br />BEING CHARGED TO EACH USER. <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, that: <br />SECTION 1. ADOPTION OF AMENDMENT REQUIRING RATE <br />REVIEW AND NOTICE <br />A new Section 201.08-M is created to the Code of Laws and <br />Ordinances of Indian River County, as follows: <br />M. Annual review of user charges and notice of rates <br />(1) Procedure: There shall be an annual review of user charges <br />to ensure <br />that <br />adequate revenues <br />are <br />generated <br />to cover <br />operation, <br />maintenance,. <br />and <br />replacement costs <br />and <br />that these <br />costs are <br />distributed <br />among users in proportion to the service provided. <br />(2) Notice: There shall be an annual notification of the rates <br />being charged to each user by inclusion of . a notice with the regular bill. <br />SECTION 2.
