Indian River Countv Legislative Delegates Session, December 21, 2016 <br />Speaker: Phyllis Frey, American Coalition 4 Property Rights <br />I am here to speak about the Affirmatively Furthering Fair .Housing Rule <br />under the department of Housing & Urban Development, with a proposal for <br />legislation that advances protection of Home Rule ofLaw from federal <br />overreach. <br />Currently, under Home Rule ()flaw local agencies control land use and <br />zoning laws that largely control where you live, the value of your home and <br />what it costs to keep it. These factors are controlled by our local <br />communities and reflect our living and voting preferences. <br />HUD & the AFFH rule is about to change all of that. Here's how. If an <br />applicant accepts a Community Development Block Grant, or others <br />embedded with the AFFH rule, HUD now controls your communities' <br />planning & zoning rights and land use. HUD's AFFH rule also forces your <br />city or county to join a region, whether you want to or not, placing the <br />priorities of the region and RPC's above local councils, commissions, P&Z <br />Boards and Home Rule of Law. <br />Grant applicants must use HUD's data tables and jurisdictions that force <br />compliance with adjoining counties that change your zoning plans to <br />conform with regional zoning plans. This effectively annexes your <br />community to a region while you forfeit control of local planning and zoning <br />land use. <br />Case histories prove that when a grant recipient fails to comply with <br />AFFH, HUD will respond with a compliance review followed by a lawsuit <br />from the Dept. of Justice. This egregious assault on private property, <br />constitutional and home rule must be stopped through legislation that will <br />protect our small communities from grants embedded with HUD's AFFH <br />rule. <br />My proposal is supported by Senate member Mike Lee in S.B. 1909, and <br />House member Paul Gossar, 14.B. 1995. Documentation I've provided shows <br />that cities and counties across the U.S. are protecting themselves through <br />similar policies. In IRC, CDBG's are being applied for and approved. Where <br />is the oversight? Where is our protection? The best means for protecting <br />Home Rule of Law is through new or amended legislation. During the first <br />week in January I will provide a template for a bill. Florida should not agree <br />to funding or assistance to any grants containing the Affirmatively <br />Furthering Fair Housing Rule. <br />
