DeBraal, Deputy County Attorney <br /> DATE: January 18, 2017 <br /> SUBJECT: 49th Street Bus Shelter Agreement with DiVosta Homes <br /> As ridership and expansion of the GoLine Indian River Transit System continues, the County has <br /> been working with developers of local projects to establish additional locations for bus shelters. <br /> GoLine has been working with County staff in order to locate desirous and safe locations with <br /> adequate property or right-of-way for installation of the prefabricated bus shelters. A shelter was <br /> recently installed at the new Chic-fil-A store on State Road 60 west of 58th Avenue by the developer <br /> of the Reserve at Vero Beach project. <br /> The corner of 49th Street and 51St Court has an unimproved bus stop. There is not sufficient County <br /> owned right-of-way present to install a shelter, so DiVosta Homes, LP has offered to provide adjacent <br /> DiVosta owned property as a site for the bus shelter. A sketch and legal description of the 287.5 <br /> square foot site are attached to this memorandum. <br /> Arcadis US, Inc., (DiVosta's agent) and County staff have drafted the attached proposed Transit <br /> Station License Agreement for use of DiVosta property for placement of the shelter. Pursuant to the <br /> proposed agreement, the License Agreement would expire three years after approval by the Board, <br /> and be subject to renewals thereafter. DiVosta would be responsible for pouring the concrete pad <br /> for the shelter and the Senior Resource Association's contractor will install the bus shelter kit at the <br /> site. Installation of the shelter will satisfy a requirement of the Waterway Village DRI Order. The <br /> County would be responsible for any repairs or maintenance to the structure and the County will <br /> agree to empty the trash cans in the shelter <br /> Fundina. DiVosta is not seeking any type of payment for the license, so the only financial impact <br /> would be installation of the shelter, estimated to be $8,500 which is the responsibility of the Senior <br /> Resource Association. <br /> Recommendation: Staff recommends the Board approve the attached Transit Station License <br /> Agreement with DiVosta and authorize the Chairman to execute the agreement on behalf of the <br /> Board of County Commissioners. <br /> c: Karen Deigl, Senior Resource Association, Inc. <br /> Wilbur Divine, Arcadis <br /> P52 <br />
