BARTON <br />CLERK <br />INDIAN ERI CO., FRA <br />A RESOLUTION ABANDONING INDIAN RIVER <br />COUNTY'S INTEREST, IF ANY, IN THE ROAD <br />AND BRIDGE WEST OF CR 507 ALONG DITCH 1 <br />NORTH OF FELLSMERE. <br />WHEREAS, the road traversing the bridge west of CR 507 <br />along ditch 1 north of the town of Fellsmere, Indian River County, <br />Florida, is private property not dedicated to Indian River County; <br />and <br />WHEREAS, existing records do not place ownership of the <br />road or bridge in the County; and <br />WHEREAS, Carson Platt, now deceased, was the owner of <br />the property; and <br />WHEREAS, Carson Platt in October 1985 requested that the <br />County Commission cease any maintenance because he has maintained <br />the road and bridge since 1942 and because said road and bridge <br />were on his private property; and <br />WHEREAS, the Board of County Commissioners acceded to <br />the request of Carson Platt O.R.(Book 62, Page 367); and <br />WHEREAS, the Commission at that time took no action <br />pursuant to Section 336.10, F.S., because none was apparently <br />required; and <br />WHEREAS, it now appears appropriate to memorialize this <br />previous action and to follow the procedure in Section 336.10, F.S., <br />WHEREAS, in accordance with Florida Statutes 336.10, <br />notice of a public hearing to consider a renouncement and disclaimer <br />of property interest has been duly published; and <br />WHEREAS, after consideration of, supporting documents, <br />staff investigation and report, and testimony of all those interested <br />and present, the Board finds that said right-of-way is not a state or <br />federal highway, nor located with in any municipality, nor is said <br />right-of-way necessary for continuity of the County's street and <br />thoroughfare network, nor is their any evidence to support a finding <br />that said road and bridge are County property. <br />
