The recipient agrees to comply with applicable requirements to report first-tier subawards of $25,000 or <br />more and, in certain circumstances, to report the names and total compensation of the five most highly <br />compensated executives of the recipient and first-tier subrecipients of award funds. Such data will be <br />submitted to the FFATA Subaward Reporting System (FSRS). The details of recipient obligations, which <br />derive from the Federal Funding Accountability and Transparency Act of 2006 (FFATA), are posted on <br />the Office of Justice Programs web site at www.ojp.gov/funding/ffata.htm (Award condition: Reporting <br />Subawards and Executive Compensation), and are incorporated by reference here. This condition, and <br />its reporting requirement, does not apply to grant awards made to an individual who received the award <br />as a natural person (i.e., unrelated to any business or non-profit organization that he or she may own or <br />operate in his or her name). <br />26. The recipient understands and agrees that it has a responsibility to monitor its subrecipients' compliance <br />with applicable federal civil rights laws. The recipient agrees to submit written Methods of Administration <br />(MOA) for ensuring subrecipients' compliance to the OJP's Office for Civil Rights at <br />Civil RiQhtsMOAeusdoi.aov within 90 days of receiving the grant award, and to make supporting <br />documentation available for review upon request by OJP or any other authorized persons. <br />The required elements of the MOA are set forth at www.oip.usdoi.gov/funding/other reguirements.htm. <br />under the heading, "Civil Rights Compliance Specific to State Administering Agencies." <br />27. The recipient agrees to submit (and, as necessary, require sub -recipients to submit) performance <br />reports on the performance metrics identified by OVC, and in the time and manner required by OVC. <br />This information on the activities supported by the award funding will assist in assessing the effects that <br />VOCA Victim Assistance funds have had on services to crime victims within the jurisdiction. Beginning <br />October 1, 2015, the recipient agrees to submit (and, as necessary, require sub -recipients to submit) <br />such information quarterly. <br />28. The recipient must require all non-profit sub -recipients of VOCA Assistance funding under this award to <br />make their financial statements available online (either on the recipient's, the sub -recipient's, or another <br />publicly available website). OVC will consider sub -recipient organizations that have Federal 501(c)(3) <br />tax status as in compliance with this requirement, with no further action needed, to the extent that such <br />organization files IRS Form 990 or similar tax document (e g , 990 -EZ), as several sources already <br />provide searchable online databases of such financial statements. <br />29. The recipient must require all non-profit sub -recipients of VOCA Assistance funding under this award to <br />certify their non-profit status. Sub -recipients may certify their non-profit status by submitting a statement <br />to the recipient (to be placed in the grant file) affirmatively asserting that the sub -recipient is a non-profit <br />organization, and indicating that it has on file, and available upon audit, either —1) a copy of the <br />recipient's 501(c)(3) designation letter; 2) a letter from the recipient's state/territory taxing body or <br />state/territory attorney general stating that the recipient is a non-profit organization operating within the <br />state/territory; or 3) a copy of the recipient's state/territory certificate of incorporation that substantiates <br />its non-profit status.
