uwuwcu �..u.ao.voca i —W. c ui a <br />The Plaintiff and Defendants have agreed, and the Court has ordered that for settlement purposes only, the <br />Litigation may be maintained as a class action under Federal Rule of Civil Procedure 23, subject to final <br />approval at the conclusion of the settlement process. If the Settlement is not finally approved, or if <br />Defendants withdraw from the Settlement Agreement pursuant to its terms, the Litigation will return to the <br />same status as before the Settlement was signed, and the Court will later determine if the case may <br />proceed as a class action. <br />3. How Do You Know If You Are a Part of the Settlement? <br />The Settlement Class includes all natural persons and entities in the United States who: <br />(i) were sent a facsimile by or on behalf of Think Simplicity, Inc. or Alexander Perovich, <br />(ii) between April 30, 2015 and February 22, 2017, <br />(iii) that advertised Think Simplicity, inc.'s products and/or services, <br />(iv) where the advertisement failed to contain opt -out language compliant with the requirements of the <br />TCPA and/or its accompanying regulations. <br />You are receiving this Notice because it is believed that you meet the above criteria and that you are a <br />member of the Settlement Class. There are approximately 272 persons in the Settlement Class. <br />4. What Are the Benefits of the Settlement and What Is the Release? <br />Each member of the Settlement Class who submits a valid, timely Claim Form will be sent a check in the <br />amount of $390 within the timeframe provided for in the Settlement. Any monies from checks that remain <br />uncashed within 180 days of issuance will be returned to the Defendants. <br />In exchange for the consideration provided by the Defendants, if the Settlement is approved by the Court, <br />the Litigation will be dismissed with prejudice as to the Defendants. The Defendants will receive a release <br />and discharge of liability from the Settlement Class Representative and from the Settlement Class. The <br />Settlement Class would not include individuals and entities who elect to opt out of the Settlement as <br />discussed below. <br />More details are in the Settlement Agreement which can be viewed at www.class-settlement.com. <br />5. What Are Your Options? <br />If you are a member of the Settlement Class, you can file a claim, do nothing, or exclude yourself from the <br />Settlement Class, or object to the Settlement. Each choice has certain consequences. You can discuss <br />your choice with Class Counsel or your own attorney <br />A. File a claim. <br />The Settlement contemplates a payment of $390 to each member of the Settlement Class that submits <br />a timely and valid Claim Form to the Settlement Administrator at the address identified on the last page <br />of this notice. <br />In order to be entitled to receive any payment from the Settlement, you must complete and sign a Claim <br />Form and submit it to the Settlement Administrator, by mail with a postmark no later than April 22. 2017, <br />or by fax, or online at www.class-settlement.com. <br />B. Do nothing. <br />If you do nothing, you will remain a member of the Settlement Class. You will lose your right to file your <br />own separate lawsuit against Defendants about their alleged advertising faxes You will receive no <br />payment in connection with the Settlement. <br />C. Opt out of the Settlement Class <br />You have the right to exclude yourself from the class action by filing a written request for exclusion with <br />the Settlement Administrator at the address identified on the final page of this notice. <br />P65 <br />
