RESOLUTION NO. 2017 - 056 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />AUTHORIZING THE FLORIDA DEPARTMENT OF <br />TRANSPORTATION TO ACQUIRE PROPERTY RIGHTS <br />ALONG STATE ROAD 60 AND 43RD AVENUE FOR <br />INTERSECTION IMPROVEMENT <br />WHEREAS, Indian River County, (County) with the assistance of the Florida Department <br />of Transportation (Department) is pursuing the construction of a roadway project for the <br />improvement of the intersection of SR 60 (20th Street) and CR 611 (43"1 Avenue) (Project), as <br />depicted in the attached Exhibit "A" and associated with Financial Management Number 431759- <br />L Section 88060-2526, in Indian River County, Florida; and <br />WHEREAS, the Project will involve the acquisition of certain property rights along the <br />Project corridor, either through administrative settlements or eminent domain proceedings; and <br />WHEREAS, the County desires for the Department to perform the right of way acquisition <br />and related activities, including eminent domain proceedings for and on behalf of the County; and <br />WHEREAS, upon the Department's completion of its acquisition activities, the County <br />will accept the acquired property from the Department; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />1. INDIAN RIVER COUNTY does hereby authorize the Department to obtain all <br />property rights needed for the Project, as part of the cooperative efforts between the Department <br />and the County. <br />2. The County hereby authorizes the Department to conduct right of way acquisition <br />and related activities, including eminent domain proceedings, on the Project, in accordance with <br />the federal Uniform Relocation Assistance and Real Property Acquisition Act of 1970, as <br />amended. <br />3. The County further authorizes the Department to utilize two parcels of County <br />owned property: the former Lennie's Lounge remainder parcel and the Mermaid Carwash parcel <br />in its negotiations for mitigation of damages and formation of cure plans associated with the <br />Project. <br />1 <br />
