12. What happens if I am a Cuss Member and I do nothing? <br />You don't have to do anything now if you want to keep the possibility of getting money or benefits from this <br />lawsuit. By doing nothing you are staying in the Class. If you stay in the Class and the Plaintiffs obtain money <br />or benefits, either as a result of a court ruling or a settlement, you will be notified about how to apply for your <br />share (or how to ask to be excluded from any settlement). Keep in mind that if you do nothing now, regardless <br />of whether the Plaintiffs win or lose the case, you will not be able to sue, or continue to sue, the United States <br />government or Administrative Office—as part of any other lawsuit—about the same legal claims that are the <br />subject of this lawsuit. This means that you will not be able to sue the government or the Administrative Office <br />of the U.S. Courts for any PACER fees paid between April 21, 2010 and April 21, 2016. You will also be <br />legally bound by all of the Orders the Court issues and judgments the Court makes in this class action. <br />13. If I am a Class Member, why would I ask to be excluded? <br />If you exclude yourself from the Class—which also means to remove yourself from the Class, and is sometimes <br />called "opting out" of the Class—you won't get any money or benefits from this lawsuit even if the Plaintiffs <br />obtain them as a result of a court ruling or from any settlement (that may or may not be reached) between <br />Plaintiffs and the United States government. However, you may then be able to sue or continue to sue the <br />government for the PACER fees at issue in this case. If you exclude yourself, you will not be legally bound by <br />the Court's judgments in this class action. <br />If you exclude yourself, you may represent yourself or hire a lawyer to represent you in your own lawsuit <br />against the government or the Administrative Office of the U.S. Courts. If you exclude yourself and bring your <br />own lawsuit, you'll have to prove your own claims, and will no longer be represented by class counsel. If you <br />choose to exclude yourself so you can start or continue your own lawsuit against the government, you should <br />decide soon whether to pursue your own case because your claims may be subject to a statute of limitations. <br />14. If I am a Class Member, how do I ask the Court, to exclude me from the Class? <br />To ask to be excluded from the Class, you must request exclusion in one of the following ways: <br />1. Send an "Exclusion Request" in the form of a letter sent by mail, stating that you want to be <br />excluded from National Veterans Legal Services Program v. United States Case No. 1:16-cv-00745-ESH <br />Be sure to include your name, address, telephone number, email address, and signature. You must mail <br />your Exclusion Request, postmarked by July 17, 2017, to: PACER Fees Class Action Administrator, <br />P.O. Box 43434, Providence, RI 02940-3434. <br />2. Complete and submit online the Exclusion Request Form found here by July 17, 2017. <br />3. Send an Exclusion Request Form, available here, by mail. You must mail your Exclusion <br />Request Form, postmarked by July 17, 2017, to: PACER Fees Class Action Administrator, <br />P.O.
