Board of County Commissioners <br />Meeting Minutes - Final June 13, 2017 <br />A motion was made by Vice Chairman O'Bryan, seconded by Chairman <br />Flescher, to: (1) approve Resolution 2017-055, confirming the special <br />assessments in connection with a water main extension from 101 Barbara Court <br />to and including 108 Barbara Court; 101 Arega Street to and including 110 Arega <br />Street; 201 Arega Street to and including 213 Arega Street; 200 Hunt Court to and <br />including 204 Hunt Court; and 201 Banks Court to and including 203 Banks <br />Court, within portions of Phase Two and Six of the subdivision of Collier Creek <br />Estates (Utility Phase 2); and providing for a water main extension from 100 <br />Harbor Point Drive to and including 117 Harbor Point Drive; and 900 S. Fleming <br />Street to and including 907 S. Fleming Street within Harbor Point Subdivision <br />(Utility Phase 3), located within the City of Sebastian, in Indian River County, <br />Florida; and providing for special assessment Liens to be made of record; and (2) <br />direct staff to combine utility phases 1, la, Ib, 2 and 3 into one bid package and <br />advertise for bids. The motion carried by the following vote: <br />Aye: 5 - Chairman Flescher, Vice Chairman O'Bryan, Commissioner Adams, <br />Commissioner Solari, and Commissioner Zorc <br />10.A.2. 17-0585 Ordinance Concerning Medical Cannabis <br />Recommended Action: <br />The County Attorney's Office recommends that the chair open the public <br />hearing and after taking public comment vote to approve the proposed <br />ordinance. <br />Attachments: Staff Report <br />Ordinance Concerning Medical Cannabis <br />Affidavit of Publication <br />County Attorney Dylan Reingold outlined the history regarding the proposed <br />Ordinance concerning medical cannabis, and explained that the Governor may <br />sign Senate Bill 8A (SB 8A) in the near future, nullifying the Ordinance. He <br />recommended that the Board open the Public Hearing for citizen input, then to <br />continue the Public Hearing to the June 20, 2017 meeting. <br />The Chairman opened the Public Hearing. <br />Bob Johnson, Coral Wind Subdivision, declared that he and his wife are <br />opposed to the Governor signing SB 8A. <br />There being no further public input, the Chairman continued the Public Hearing <br />to June 20, 2017. <br />Discussion ensued amongst the Board, Attorney Reingold and County <br />Administrator Jason Brown, regarding the concern of the availability of medical <br />marijuana or medical cannabis within the community. The consensus was for <br />Attorney Reingold to contact the five municipalities and Florida Association of <br />Counties to ensure that there will be facilities available within Indian River <br />County, then to return to the Board on either July 11, 2017 or July 18, 2017 <br />with a proposed ordinance banning facilities from being located in the <br />unincorporated areas of the County. <br />Indian River County Florida <br />Page 8 <br />
