Board of County Commissioners <br />Meeting Minutes - Final June 20, 2017 <br />A motion was made by Vice Chairman O'Bryan, seconded by Chairman Flescher, <br />to approve: (1) Ordinance 2017-006, amending Section 312.11 (Performance <br />Security), Section 312.13 (Termination of Use or Removal of Object) and Section <br />312.14 (Public Protection and Liability) of Chapter 312 (Rights -of -Way) of the <br />Code of Indian River County, Florida in order to provide additional requirements <br />for installation in County rights-of-way; and providing for codification, <br />severability, repeal of conflicting provisions, and an effective date; and (2) <br />Resolution 2017-062, establishing a fee schedule for installation within County <br />right-of-way. The motion carried by the following vote: <br />Aye: 5 - Chairman Flescher, Vice Chairman O'Bryan, Commissioner Adams, <br />Commissioner Solari, and Commissioner Zorc <br />10.A.4. 17-0655 <br />Recommended Action: <br />The Chairman called for a recess at 10:06 a.m., and reconvened at 10:17 a.m., with all <br />members present. <br />Ordinance Concerning Medical Cannabis (Continued from June 13, 2017) <br />(Legislative) <br />The County Attorney's Office recommends that the chair open the public hearing <br />and after taking public comment vote to approve the proposed ordinance. <br />Attachments: Staff Report <br />Ordinance Concerning Medical Cannabis <br />Additional Backup- Proof of Publication 10.A.4 <br />(Clerk's Note: This Item heard before Item 10.A.1 and placed here for continuity.) <br />County Attorney Dylan Reingold noted that the Ordinance on Medical Marijuana <br />Regulations that had been previously adopted by the Board would be nullified by <br />the Medical Marijuana legislation that has been passed during this Special <br />Legislative Session. He stated that the Bill had not yet been signed by the <br />Governor, but that the Governor had two weeks to take action on the proposed <br />legislation. Attorney Reingold felt that based on the news reports, the Governor <br />planned to sign the Bill, and made the request to take public comments and defer <br />this item to the July 11, 2017 meeting. He provided background from discussions <br />regarding the options that local governments have with respect to regulations on the <br />medical marijuana treatment center dispensing facilities, and provided an update on <br />the plans that the surrounding areas had with respect to the dispensing facilities. He <br />encouraged those members of the Board who were attending the Florida <br />Association of Counties Conference (FAC) to poll their fellow Commissioners as to <br />how the central region was going to respond to the legislation, and requested <br />direction from the Board as to how to proceed with the drafting of an Ordinance <br />that pertains to the banning of the facilities within the unincorporated areas. <br />Indian River County Florida <br />Page 11 <br />
