Where <br /> the Applicant requires usage after the stipulated time, Applicant is required to pay additional <br /> charges including, but not limited to standard hourly/daily rates and any overage fees as set forth <br /> in the Fairgrounds Fee Schedule attached as Exhibit B ("Fee Schedule"). <br /> B. AUTHORIZED USE, TERMS & CONDITIONS: <br /> The Premises are to be used by Applicant for the Thunder on the Beach Pow Wow (the '`Event"), <br /> Thunder on the Beach Pow Wow is a non-profit event for the promotion of Native American Cultures. <br /> The event hosts Native American drumming and dancers in costume who participate in native culture <br /> dances, children as well as adults. The event also hosts vendors who sell and demonstrate Native <br /> American items and art. 10X10 tents and various teepees are used for the vendor set-ups. Educational <br /> booths are also provided to demonstrate Native American heritage, culture and history. Food vendors are <br /> also on site. <br /> 1. <br /> (a) The Event may include the following activities: Dancing, Native American basket <br /> weaving and other demonstations. Vendors, Wild Bill Show (Knife-Throwing Show & <br /> Whip Demonstration. Teepee Demonstation. Music, drumming, and other Native themed <br /> music. <br /> (b) The hours of the Event shall be: Fri 3-9:30pm, Sat 10am-9:30pm and Sun 10am-5:30pm <br /> (c) The Event shall be used for no other purpose whatsoever, unless prior written approval is <br /> requested in writing by Applicant and given by the County which approval shall be <br /> subject to availability but not be unreasonably withheld, conditioned, or delayed so long <br /> as such request is submitted at least 90 days prior to the beginning of the License <br /> Duration. Such change may result in a modification of the insurance requirements set <br /> forth in B. 17. <br /> 2.County agrees not to schedule another Pow Wow event within 30 days before or after this Event <br /> unless the Applicant signs a waiver stating permission to proceed with another Pow Wow <br /> themed event as disclosed. <br /> 3.The Applicant shall have first right of refusal for the following dates: <br /> (a) February 14-18, 2019 <br /> (b) February 13-17, 2020 <br /> (c) February 19-22, 2021 <br /> and will have 30 calendar days from the last day of the previous year's event, to provide a <br /> security deposit which shall be a minimum of 25% of the Fairgrounds License Agreement Fees <br /> Schedule in effect at that time to the County to secure the subsequent year's date. If the <br /> Applicant fails to provide the security deposit as described within this section, the Applicant <br /> forfeits the reservation of all future dates under this License Agreement. <br /> 4.Applicant agrees to pay to the County as rent, costs, expenses and taxes for the use of the <br /> Premises the following sums: <br /> Fairgroun License Agreement Page 3 of 12 <br /> Initials September 25,2017 <br />
