POLMANN <br />NOTICE OF PROPOSED AGENCY ACTION ORDER <br />APPROVING DUKE ENERGY FLORIDA, LLC'S <br />STANDARD OFFER CONTRACT AND RATE SCHEDULE <br />BY THE COMMISSION: <br />NOTICE is hereby given by the Florida Public Service Commission that the action <br />discussed herein is preliminary in nature and will become fmal unless a person whose interests <br />are substantially affected files a petition for a formal proceeding, pursuant to Rule 25-22.029, <br />Florida Administrative Code (F.A.C.). <br />Background <br />Section 366.91(3), Florida Statutes (F.S.), requires that each investor-owned utility (IOU) <br />continuously offers to purchase capacity and energy from renewable generating facilities and <br />small qualifying facilities. Florida Public Service Commission (Commission) Rules 25-17.200 <br />through 25-17.310, Florida Administrative Code (F.A.C.), implement the statute and require <br />each IOU to file with this Commission, by April 1 of each year, a standard offer contract based <br />on the next avoidable fossil fueled generating unit of each technology type identified in the <br />utility's current Ten -Year Site Plan. On March 30, 2017, Duke Energy Florida, LLC (DEF) filed <br />a petition for approval of its amended standard offer contract and rate schedule and amended <br />interconnection agreement based on its 2017 Ten -Year Site Plan. The standard offer contract <br />requires execution of the interconnection agreement; however, the interconnection agreement <br />can be utilized without the standard offer contract. <br />At the Commission Conference held on July 13, 2017, we discussed concerns regarding <br />certain terms of the amended standard offer contract, such as changes to completion/performance <br />security provisions and inclusion of language for right of refusal regarding environmental <br />attributes. We deferred the item and on July 14, 2017, DEF filed a revised amended standard <br />offer contract to address these concerns. <br />
