PSC -2017 -0336 -PAA -EQ <br />DOCKET NO. 20170072 -EQ <br />PAGE 29 <br />Attachment A <br />e' DUKE <br />I ENERGY. <br />SECTION No. IX <br />FOURTHf IFTH REVISED SHEET NO. 9.420 <br />CANCELS VNIRD-FOURTH REVISED SHEET NO. <br />9A20 <br />8.5 The Committed Capacity Test shall be performed according to standard industry <br />testing procedures for the appropriate technology of the RF/QF. <br />8.6 The results of any Committed Capacity Test, including all data related to Facility <br />operation and performance during testing, shall be submitted to DEF by the <br />RF/QF within seven (7) calendar days of the conclusion of the Committed <br />Capacity Test. The RF/QF shall certify that all such data is accurate and complete. <br />9. Payment for Electricity Produced by the Facility <br />9.1 Energy <br />9.1.1 <br />DEF agrees to pay <br />the RF/QF for energy produced by the Facility and delivered to DEF in <br />accordance with the rates and procedures contained in Appendix D, as it <br />may be amended from time to time. The Parties agree that this Contract <br />shall be subject to all of the provisions contained in Rate Schedule COG -1 <br />or Appendix D whichever applies as approved and on file with the FPSC. <br />9.1.2 DEF may, at its option, limit deliveries under this Contract to 110% of the <br />Committed Capacity as set forth in Section 7. In the event that DEF <br />chooses to limit deliveries, any energy in excess of 110% of the <br />Committed Capacity will be paid for at the rates defined in Rate Schedule <br />COG -1 and shall not be included in the calculations in Appendix A hereto. <br />9.2 Capacity <br />DEF agrees to pay the RF/QF for the Capacity described in Section 7 in <br />accordance with the rates and procedures contained in Appendix D, as it may be <br />amended and approved from time to time by the FPSC, and pursuant to the <br />election of Option of Appendix D or an alternative rate schedule in <br />Appendix E. The RF/QF understands and agrees that Capacity Payments will <br />only be made if the Capacity Delivery Date occurs before the Required Capacity <br />Delivery Date and the Facility is delivering firm Capacity and Energy to DEF. <br />Once so selected, this Option, the Firm Capacity Rate and/or the Firm Energy <br />Rate cannot be changed for the term of this Contract. <br />ISSUED BY: Javier Portuondo, Director.
