PSC -2017 -0336 -PAA -EQ <br />DOCKET NO. 20170072 -EQ <br />PAGE 39 <br />Attachment A <br />(� DUKE <br />1 ENERGY. <br />SECTION No. IX <br />THIRD-FOURTH REVISED SHEET NO. 9.430 <br />CANCELS SECOND-THIRD REVISED SHEET NO. <br />9.430 <br />17.2 The RF/QF Insurance for liability shall have a minimum limit of five million <br />dollars ($5,000,000.00) per occurrence for bodily injury (including death) or <br />property damage. This liability limit can be met by any combination of <br />commercial general and excess liability insurance policies. <br />17.3 To the extent that the RF/QF Insurance is on a " claims made " basis, the <br />retroactive date of the policy(ies) shall be the Effective Date of this Contract or an <br />earlier date. Furthermore, to the extent the RF/QF Insurance is on a "claims <br />made" basis, the RF/QF's duty to provide insurance coverage shall survive the <br />termination of this Contract until the expiration of the maximum statutory period <br />of limitations in the State of Florida for actions based in contract or in tort To the <br />extent the RF/QF Insurance is on an "occurrence" basis, such insurance shall be <br />maintained in effect at all times by the RF/QF during the term of this Contract. <br />17.4 The RF/QF shall provide DEF with a copy of any material communication or <br />notice related to the RF/QF Insurance within ten (10) Business Days of the <br />RF/QF's receipt or issuance thereof. <br />17.5 DEF shall be designated as an additional named insured under the RF/QF <br />Insurance (except Workers' Compensation). The RF/QF Insurance shall be be <br />primary to any coverage maintained by DEF and provide, where permitted by <br />law, waiver of any rights of subrogation against DEF. Any deductibles or <br />retentions shall be the sole responsibility of RF/QF. RF/QF's compliance with <br />these provisions and the limits of insurance specified herein shall not constitute a <br />limitation of RF/QF's liability or otherwise affect RF/QF's indemnification <br />obligations pursuant to this Contract Any failure to comply with all of these <br />provisions shall not be deemed a waiver of any rights of DEF under this <br />Contractor with respect to any insurance coverage required hereunder.
