DeBraal, Deputy County Attorney <br />Kate Pingolt Cotner, Assistant County Attorney <br />MEMORANDUM <br />TO: The Board of County Commissioners <br />FROM: Dylan Reingold - County Attorney <br />DATE: September 14, 2017 <br />SUBJECT: Wild Turkey Sand Mine — Fourth Phase <br />Cash Deposit and Escrow Agreements for Compliance and <br />Restoration <br />In 2009 the Planning and Zoning Commission approved the request for major <br />site plan and administrative permit use approval for a sand/coquina mine known <br />as Wild Turkey; and both compliance and restoration security in the form of cash <br />were posted for Phase 1. Phase 1 was restored and, in June of 2015, the <br />posted funds were transferred to the second phase. The second phase was <br />thereafter restored and the funds were then transferred to the third phase. The <br />third phase has now been restored to the satisfaction of the County based on <br />site inspection, and the developer is ready to proceed to the fourth phase and <br />wishes to transfer those funds presently in escrow with the County from the third <br />phase to its fourth phase. <br />Attached for your approval are both the compliance and restoration Cash <br />Deposit and Escrow Agreements for the fourth phase - the compliance security is <br />in the amount of $49,800.00; and the restoration security is in the amount of <br />$67,710.90. Both agreements earmark the transfer of the funds. <br />RECOMMENDATION: <br />Authorize the Chairman of the Board of County Commissioners to execute the <br />two compliance and restoration Cash Deposit and Escrow Agreements with <br />regard to the transfer from the third phase to the fourth phase. <br />/nhm <br />attachments <br />P33 <br />
