RESOLUTION 2017- 17-1 <br /> A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br /> INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING, <br /> ABANDONMENT,VACATION AND DISCONTINUANCE OF THE PORTION <br /> OF 21ST PLACE RIGHT-OF-WAY RUNNING BETWEEN 97TH ROAD AND <br /> EAST 98TH AVENUE LYING SOUTH OF LOTS 1-3, BLOCK I-I AND NORTH <br /> OF LOTS 7-9 BLOCK H-H OF THE VERO TROPICAL GARDENS, UNIT 2 <br /> SUBDIVISION AS SHOWN IN PLAT BOOK 6, PAGE 64 OF THE PUBLIC <br /> RECORDS OF INDIAN RIVER COUNTY, AS DESCRIBED HEREIN; SAID <br /> ABANDONMENT SUBJECT TO RETAINING A DRAINAGE EASEMENT. <br /> WHEREAS, on April 5, 2017, Indian River County received a duly executed and <br /> documented petition from Dee Brown requesting that the County close, vacate, abandon, <br /> discontinue, renounce, and disclaim any right, title, and interest of the County and the public in <br /> and to a portion of the 21' Place right-of-way running between 97th Road and East 98th Avenue <br /> lying south of lots 1-3, Block I-I and north of lots 7-9 block H-H of the Vero Tropical Gardens, <br /> Unit 2 Subdivision as shown in Plat Book 6, Page 64, of the Public Records of Indian River <br /> County, Florida; and <br /> WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to <br /> consider said petition was duly published; and <br /> WHEREAS, after consideration of the petition, supporting documents, staff investigation <br /> and report, and testimony of all those interested and present,the Board finds that the subject right- <br /> of-way is not a state or federal highway, not located within any municipality, not necessary for <br /> continuity of the County's street and thoroughfare network, and does not provide exclusive access <br /> to any private property; and <br /> WHEREAS, the Board finds that a 20 foot wide drainage easement needs to be retained <br /> along the centerline of the subject portion of right-of-way to accommodate possible future drainage <br /> improvements. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br /> 1. All right, title and interest of the County and the public in and to that certain right-of-way <br /> segment more particularly described as follows: <br /> THAT CERTAIN PORTION OF ROAD RIGHT OF WAY KNOWN AS 21ST PLACE <br /> AS SHOWN ON THE PLAT OF VERO TROPICAL GARDENS UNIT 2 AS <br /> RECORDED IN PLAT BOOK 6, PAGE 64, OF THE PUBLIC RECORDS OF INDIAN <br /> RIVER COUNTY, FLORIDA <br /> BEING MORE PARTICULARLY DESCRIBED AS: <br /> ALL THAT ROAD RIGHT-OF-WAY LYING SOUTH OF, ADJACENT TO AND <br /> CONTIGUOUS WITH LOTS 1 THRU 3 INCLUSIVE OF BLOCK I-I; LYING NORTH <br /> OF, ADJACENT TO AND CONTIGUOUS WITH LOTS 7 THRU 9 INCLUSIVE OF <br /> 1 <br />
