Florida City Gas <br />FPSC Natural Gas Tariff <br />Volume No. 9 Original Sheet No. 67 <br />THIRD PARTY SUPPLIER (TPS) <br />(Continued) <br />DAILY AND MONTHLY CONTRACT BALANCING (Continued) <br />b) Monthly Imbalance Cash -Out Charge (Continued) <br />(2) For overdeliveries the amount payable by the Company shall be the Imbalance <br />Quantity multiplied by the product of the corresponding Imbalance Level Factor and the applicable <br />price per therm. The price per therm shall be the Company's lowest supplier commodity rate <br />applicable to the billing month in which the Customer overtendered gas to the Company, or the <br />monthly average spot price for gas delivered to Florida Gas Transmission at Tivoli, as reported in <br />Natural Gas Week plus Florida Gas Transmission Company's transportation cost and fuel, if <br />applicable. In the event that this price is no longer available or the basis upon which such price is <br />reported or calculated in such publication changes substantively, Company will file to change its <br />tariff and may, at its discretion, select a representative price in the interim period, subject to FPSC <br />approval. <br />The offering of gas service above the 5% allowed imbalance for the month is at the sole <br />discretion of the Company. If it determines that it cannot continue to provide such service or that it <br />must limit such service, it will notify TPSs served under this Rate Schedule. The use of service <br />above ,the level allowed by the Company after notification shall constitute Unauthorized Gas Use <br />and shall be subject to the Unauthorized Gas Use charges specified in the Rules and Regulations <br />section of this tariff. <br />CAPACITY ASSIGNMENT <br />TPSs will be required to obtain firm interstate pipeline capacity into the Company's <br />distribution system at points designated by the Company at a quantity equivalent to their <br />Customers' aggregate ADDQ. TPSs that do not demonstrate sufficient interstate firm capacity <br />will be required to accept assignment of such capacity from the Company. The Company will <br />assign each of its firm Interstate pipeline capacity contracts in proportion to the Company's total <br />capacity portfolio at the current the Federal Energy Regulatory Commission approved rates. <br />Refer to Rules and Regulations Section 12 (Transportation — Special Conditions) for the <br />terms associated with the Capacity Assignment process for TPSs. <br />TREATMENT OF REVENUE <br />All revenue produced under this Rate Schedule derived from any balancing charges or <br />other revenue related to the recovery of gas costs, exclusive of applicable taxes and <br />assessments, shall be credited to the Purchased Gas Adjustment Clause. <br />STANDARDS OF CONDUCT <br />In addition to the above terms and conditions, TPS' must agree to comply with any <br />standards of conduct or other requirements set forth by the Florida Public Service Commission. <br />Issued by: Carolyn Bermudez Effective: <br />Vice President, Florida City Gas <br />(D' 4 / <br />
