RESOLUTION 2018- 009 <br /> 3. That an equally good or more desirable form of installation can be <br /> employed in any specific case. <br /> 4. The true intent and meaning of this code or any of the regulations there <br /> under have been misconstrued or incorrectly interpreted. <br /> 5. A citation or an administrative complaint has been filed by the Building <br /> Official. <br /> Appeals of decisions and interpretations of the building official relating to the Florida <br /> Building Code, (see section 113.4.2 of the Florida Building Code), must be made to the <br /> Florida Building Commission as outlined in Florida Statute §553.775. <br /> 6. GENERAL PROVISIONS. <br /> The provisions of Title 1, Chapter 103, relating to boards and commissions shall apply <br /> to this Committee. The Board shall elect from among its voting members a chairman <br /> and a vice chairman at its first meeting of each year. Each chair and vice chair shall <br /> serve for a one-year term and may be reelected but shall be limited to two successive <br /> annual terms, at which point they would be ineligible to chair the committee for at least <br /> one year. <br /> 7. MEETINGS. <br /> The Board shall meet within 30 calendar days after notice of appeal has been received. <br /> Meetings shall be held as decided by the Committee in coordination with County staff. <br /> A meeting may be called at the request of the chair of the Committee. The agenda for <br /> each meeting shall be established by the chairman in coordination with County staff. <br /> The chairman, staff or any Committee member may place matters on the agenda. Any <br /> Committee member may make an oral or written report on committee activity at a <br /> subsequent Board of County Commissioners meeting under "Public Discussion Items" <br /> or under "Departmental Agenda Matters" with the concurrence of staff. <br /> 8. DECISIONS. <br /> The Construction Board of Adjustment and Appeals shall, in every case, reach a <br /> decision without unreasonable or unnecessary delay. Each decision of the board shall <br /> also include the reasons for the decision. If a decision of the board reverses or modifies <br /> a refusal, order, or disallowance of the building official or varies the application of any <br /> provision of this code, the building official shall immediately take action in accordance <br /> with such decision. Every decision shall be promptly filed in writing in the office of the <br /> building official and shall be open to public inspection. A certified copy of the decision <br /> shall be sent by mail or otherwise to the appellant and a copy shall be kept publicly <br /> posted in the office of the building official for two weeks after filing. Every decision of <br /> the board shall be final, subject however to such remedy as an aggrieved party might <br /> have at law or in equity. <br />
