DeBlois, AICP <br />Chief, Environmental Planning <br />& Code Enforcement <br />FROM: Kelly Buck <br />Code Enforcement Officer <br />DATE: 2/10/2015 <br />RE: John and Kari Tench's Request for Partial Release of an Easement at 5821 Bent Pine <br />Drive (Bent Pine Subdivision, Unit 4) <br />It is requested that the Board of County Commissioners formally consider the following information at <br />the Board's regular meeting on February 17, 2015. <br />DESCRIPTION AND CONDITIONS <br />The County has been petitioned by John Robert Tench and Kari Lee Tench, owners of a lot at 5821 Bent <br />Pine Drive in Unit 4 of Bent Pine Subdivision, for release of a l0 -foot wide portion of a rear yard 50 -foot <br />drainage, utility and golf course maintenance easement on the lot. The purpose of the partial easement <br />release request is to allow for construction of a pool deck and screen enclosure (see attached maps). <br />ANALYSIS <br />The request has been reviewed by Florida Power & Light Corporation; Comcast Cable Services; the <br />Indian River County Utilities Department; the County Road & Bridge and Engineering Divisions; the <br />County surveyor; and the Bent Pine Golf Club. None of the utility providers or reviewing agencies <br />expressed an objection to the requested partial release of easement. Therefore, it is staff's position that <br />the requested partial easement release would have no adverse impact to drainage or to utilities being <br />supplied to the subject property or to other properties. <br />RECOMMENDATION <br />Staff recommends that the Board, through adoption of the attached resolution, approve release of the 10 - <br />foot wide portion of the rear yard 50 -foot drainage, utility and golf course maintenance easement <br />described in the resolution. <br />124 <br />
