Nixon, P.E., Roadway Production ManagerA/ <br />AWARD OF BID <br />Old Dixie Highway Sidewalk from 38th Lane to 45th Street <br />IRC Project No. 0845B, Bid No. 2014032 <br />DATE: January 28, 2015 <br />DESCRIPTION AND CONDITIONS <br />On September 8, 2014, the Board of County Commissioners entered into a Local Agency Program Agreement <br />(LAP) FM # 423186-2-58-01 with the Florida Department of Transportation (FDOT) for the construction of a <br />sidewalk along Old Dixie Highway. The project consists of 3/4 miles of 5 -foot wide concrete sidewalk along <br />the east side of Old Dixie Highway from 38th Lane to 45th Street. <br />The bid opening for the project was held on November 12, 2014. Five (5) bids were received and opened. A <br />detailed bid tabulation is on file and available for viewing in the County Engineering Division. Bid totals are <br />as follows: <br />Florida Site Contracting <br />Timothy Rose Contracting, Inc. <br />Guettler Brothers Construction, Inc. <br />Stillwater Construction, Inc. <br />Dato Construction, Inc. <br />Vero Beach, Florida <br />Vero Beach, Florida <br />Ft. Pierce, Florida <br />Malabar, Florida <br />Vero Beach, Florida <br />*Denotes mathematical errors were found and bid amounts corrected. <br />$122,901.25 <br />$129,200.52 <br />$148,739.00 <br />$176,400.00 * <br />$181,974.74 <br />One bid was disqualified; Florida Site Contracting does not meet the required qualifications in the contract <br />documents and is not responsible or responsive in its work. Florida Site Contracting does not have "at least <br />five years" experience in construction of similar projects of this size and larger. Florida Site Contracting has <br />failed to complete and comply with the contract documents in a timely manner on past and ongoing jobs <br />with the County. The County has a duty to select not only the lowest, but the most responsive, responsible <br />bidder. Florida Site Contracting is registered as a fictitious name owned by Ag-Scape Services, Inc. with <br />Shane Barry listed as president. Mr. Barry responded to the Qualification of Bidders using a fictitious name <br />entity that existed for less than two years at the time his bid was submitted. Ag-Scape Services, Inc. has a <br />current contract with Indian River County for repairs to the County Shooting Range. The project completion <br />date was set for lune 22, 2014 and is still not completed. Mr. Barry, on behalf of Ag-Scape Services, Inc., has <br />failed to conform his work to the bid specifications and when told of his non -conforming work on the <br />project, failed to comply in a timely manner as the job is still not complete and not closed out despite written <br />warnings to do so.
