NOV 3 19 <br />BOOK 87 P,irE 962 <br />DONATION OF RIGHT OF WAY AGREEMENT ADDENDUM - INDIAN RIVER <br />BOULEVARD PHASE IV <br />The Board reviewed the following memo dated October 27, <br />1992: <br />TO: James E. Chandler, <br />County Administrator <br />FROM: James W. Davis, P.E.,._, <br />Public Works Director <br />SUBJECT: Donation of Right -of -Way Agreement Addendum <br />Indian River Boulevard Phase IV <br />DATE: October 27,}1992 FILE: lawton.agn <br />DESCRIPTION AND CONDITIONS <br />On November 1, 1988, the County entered into an Agreement between <br />Abner P. 4 Betty A. Lawton and Equal Split, Inc. donating to the <br />County right-of-way for the extension of Indian River Boulevard <br />provided the County would make certain access improvements and <br />complete the Boulevard by a certain time period. <br />The attached agreement addendum is to extend the original Nov. 1, <br />1988 agreement by two years so that Indian River Boulevard Phase <br />IV can proceed. Also attached is an invoice from the Lawton's <br />attorney for professional services for $250. <br />ALTERNATIVES AND ANALYSIS <br />The following alternatives are presented. <br />Alternative No. 1 <br />Authorize the Chairman to execute Addendum No. 1-B to the <br />Agreement and payment of Attorney fees. <br />Alternative No. 2 <br />Deny the Authorization thereby forfeiting the extension of <br />time. Also deny payment of Attorney fees. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends Alternative No. 1. Funding to -be from 3091215- <br />541-066.12 <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously approved <br />Addendum No. 1-B to Agreement for Donation of Right - <br />of -Way, and authorized payment of attorney's fees in <br />the amount of $250.00, as recommended by staff. <br />AGREEMENT ADDENDUM IS ON FILE <br />IN THE OFFICE OF CLERK TO THE,BOARD - - <br />28 <br />
